Ok, I was reading this whole thread this morning and now I'm a little nervous about my taxes and the AOS. While I make well above the federal guidelines for two people, and have been stable in this job since the end of Oct 2011, my 2011 tax year was not quite as successful. I moved to Chicago to start a PhD program that year and didn't work until after the program fell apart over the summer and acquired this job. 2009 and 2010 also far exceeded the guidelines for two years, so it's only my most recent completed tax year that's troubling.

I haven't done my 2012 taxes yet because I'm filing married filing separately and the IRS informed me that I wouldn't be able to efile this year since I have a non-resident alien husband. My employer will provide me with a letter and I have a letter they wrote last summer when I started this whole process, so they'll also be able to see a significant pay raise in the year... but now I'm worried about that 2011 tax return.

Suggestions? Thoughts?

We also went the k3 route just as another option! NVC will almost always close that petition. When you filed it you already had the I 130 in process. They usually always get to NVC together. Since the intent of the k3 is to bring your spouse here while the I 130 is being processed, if they see the I 130 is at the NVC stage they will automatically close the k3 since the I 130 is almost complete and the k3 serves no purpose

Either quickly file your 2012 and have that ready.

Or for you its explainable you were in a PHD program. Write a coverletter saying that.

I have the same situation. 2011 I was with my husband in Nigeria. I submitted 2008,2009,2010 and it shows more than enough.

So they see the down year was due not cuz of I can't find work or unemployable but I wasn't here. 2012 I just worked 5 months and made 3 times what was required so you will be okay I believe.

That's a good suggestion. I hadn't thought about that. Thanks!

I'm not quite a Dr. The program fell apart, but I intend on finding another program. I just actually, despite the crazy hours and the stress, like my job. So when I look for another program, I hope to keep working as well.

Still you should call and change address get it done immediately and not holding up anything. AOS is about Petitioner anyway.

Ya, that's the thing that troubles me - that decision tree to 'stop all' till the beneficiary's address is fixed by NVC,

as

the IV Unit uses the address in the DS-230, which hasn't been submitted yet.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

On the form to request a police clearance there's a question asking where you're going to submit the clearance. They also ask for what purpose but we chose immigration, but should I put NVC or the Embassy as the agency who's going to receive the PCC? I was thinking Embassy since they're the ones actually going through the papers, NVC just gathers it and makes sure everything is there, right?

I saw your K3 was canceled. No worries, considering how much money you two will save going the CR1 path you will be thankful in the end. You have your entire lives together. What another 4 weeks? Promise!

Sometime in October, 2011: We met online talking about Argentina.
Later in October: Met in person in Philadelphia and became good friends.
March 4, 2012: Became girlfriend and boyfriend, officially.
March 21: Gloria leaves the US at the end of her J-1 Visa.
April 9: Got engaged!
May 12-26: Chris visits Buenos Aires.

I can't stop blaming myself now :( it raised my hope when it got to the consulate and now it's shattered like glass....I'm sorry I don't mean to rant but I am feeling really down right now. I really don't care of the advantages I just wanted to go home to my hubby. If only they had sent my I-130 to the NVC on time I would have been done with it by now :(

yup looks like I won't make it for my 1st wedding anniversary which is in March :(

why didn't you file the cr1 in march after your wedding and waited until october to file it? you would have been done by now.

I think I'm gonna get a state ID. Do I need to carry my green card on me? Or is it better to keep it in a safe place?

I carry my green card on me at all times. It has its own spot in my wallet :)

I believe somewhere in the welcome letter or some other government place it states that you need to have the green card on you at all times. Although I've heard people would just keep a photocopy of the green card on them and keep the green card in a safe. But, if you ever get stopped and don't have your green card on you, it may lead to issues. So, it's ultimately up to you.

It actually took me by surprise, I didn't know the consulate would close it after it survived the NVC. There isn't much I can do anyways. I just wish they had sent my I-130 to NVC on time now that they closed my K3

It is up to you. However, it is much better to carry State ID or US driver licence instead.

Because, if for some reason you lost it, it will be pain getting the new one from uscis.

In contrast, if you lost a driving licence/state id - it is very quick (same day) and less expensive to get a new one.

I don't think I would have been, ppl that applied early last year are not done yet. We were on vacation for some time, I am actually glad I'm not among the ppl at CSC still waiting for my approval. I would have gone insane
