NVC Filers - February 2013

NVC still has yet to receive my case. I was looking for some advice on preparing a cover letter in regards to my marriage certificate. We have a marriage certificate issued from the temple in which we were married in India. However we were not able to obtain a marriage registration certificate which according to the Department of State is a required document. The document is unobtainable due to an official's error in India. In short, we have exhausted all possibilites to obtain this certificate. I am trying to demonstrate that the document is unobtainable through no fault of our own. I plan on attaching a letter explaining that we have tried to register the marriage according to the appropriate marriage act and local, state, and federal laws in India. We also have a significant amount of evidence demonstrating that our marriage is real and genuine and that we have made many attempts at registration.

I had absolutely no trouble with USCIS but I am worried that the NVC will issue either an RFE or place us into AP until we provide the registration document. Can anyone provide some advice on the best way to prepare our package to the NVC?

I am the petitioner.

Anybody know where I can get the NVC checklist that I am required to attached to get Singapore Police clearance? I understand that i need the request letter and the checklist. While waiting for my DS 3032 to be accepted, I'm gathering all docs now so that as soon as the IV is paid, I can quickly send the package to them.... Thanks!

There is no NVC checklist you can go get. You'll have to send your IV package as is. Once it's reviewed, NVC will issue you a checklist for the missing police certificate. You'll then use that checklist to request the police certificate.

thank u saylin! maybe my husband should also write a letter of explanation why he has zero income :-)

Yes, that's a really good idea good.gif

When I submit my info to the NVC, I want to include More photographs along with additional bonafide evidence so I wanted to know whether I should include one or two copies of the photographs? For the I–130 I only submitted one copy of the photographs and 2 copy of every other document. So do I need to send in 2 albums with the same pictures in it?

No need to send multiple copies of evidence. It's never been a requirement. Your multiple copies with the I-130 petition was not needed. Just send one copy.

I was approved january 29 can i call by my self my husband is my petitioner thats what Im Worried to that USCiS was not able to send NVC

The beneficiary can't call USCIS. They won't talk to you. Only the petitioner can call USCIS. Both parties can call NVC though.

AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAND we have Case and Invoice ID Numbers!!! yaaaaaaay!!

Now I just need to hope and pray that my taxes have been processed on Monday! Which is what I'm worried about, I called the IRS a couple of days ago and they said that they still haven't processed it and that they need 4-6 weeks, maybe longer. What would happen if I sent in my returns with the AOS before the IRS finished processing? Keep in mind that financially we're totally relying on my father as joint sponsor since I'm overseas and therefore don't have any income that can be used to sponsor. Has anyone come across this problem?

Grats! kicking.gifkicking.gif

Great news. After 55 days from NOA2, I finally received my case number and invoice identification number today. DS-3032 was also emailed to them today.

It's about time!! Congrats!!!! kicking.gifkicking.gifkicking.gifkicking.gif

NVC doesn't place IR-1/CR-1 applicants into AP. They would just issue you a checklist and wait for your response. If no response within a year, then the case is closed. I would say send in all the evidence you have. Include a typed letter about your situation, as well as listing all the evidence you're including. Write this on a separate sheet from your cover letter (if you're including one).

Good luck!

Okay saylin it is the 1040ez thanks so much your a life saver ( Hugs) yes.gif. Now I can get a good night's rest until this evidence go out Monday....

The tax transcript is based off a tax return that was filed. Which tax return form was filed? It should say on the top of the transcript. Then, once you know, go back to my previous post to find out which amount line you're supposed to use. Do not just guess and choose a random line because, if you're wrong, it'll cost you another checklist.

I'm not frustrated, I just want to make sure you get the right amount!

Alright, if the 1040EZ was filed, then the adjusted gross income is used. Glad you got it good.gif

Just called NVC. Operator (he sounded like he is very tired, BTW) says that our AOS has been approved on tuesday Feb 19th (YAY!)   You were right Saylin!!

No email that confirms AOS has been accepted though.

The DS-261 has not been approved, he said that is in the system but NOT REVIEWED yet  so we can't get invoiced yet.

We are gonna call once again just to double check, haha

I'm hoping that we are making a bigger deal of this than it actually is. What would happen if they send out a checklist and the documentation we provide as a response is not satisfactory?

If that were to happen, you'd have to talk with a supervisor and explain the situation, that you cannot get what they need. They would then review your documents and close your case.

Sending to:

National Visa Center

There's no specific order, but this is what I would do with your documents:

AOS package

-bar-coded cover sheet (must be first!!)

-I-864

-2012 1040

-2012 W2

-letter of employment

-pay stub

IV package

-bar-coded cover sheet (must be first!!)

-DS-230

-passport photos (in ziploc bag with bag stapled to blank sheet)

-passport bio page

-original birth certificate

-photocopy of birth certificate

-original marriage certificate

-photocopy of marriage certificate

-original NBI clearance

If you're sending both packages together, then I suggest putting each package in its own manila envelope. Mark on the two envelopes your case number, beneficiary's full name, as well as the name of the package (Affidavit of Support, Immigrant Visa). Then put both manila envelopes into a mailing envelope.
