AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAND we have Case and Invoice ID Numbers!!! yaaaaaaay!!

Now I just need to hope and pray that my taxes have been processed on Monday! Which is what I'm worried about, I called the IRS a couple of days ago and they said that they still haven't processed it and that they need 4-6 weeks, maybe longer. What would happen if I sent in my returns with the AOS before the IRS finished processing? Keep in mind that financially we're totally relying on my father as joint sponsor since I'm overseas and therefore don't have any income that can be used to sponsor. Has anyone come across this problem?

First - YAY ROOSHA CONGRATS! So glad you FINALLY got your case number! :D

Second - You and I are basically in the same situation insofar as I-864/finances and all of that blah blah. As long as you have a cosponsor, I don't really think it matters if you send yours before it's finished processing, as long as your father's stuff is in order, since he'll be the primary source of income.

In fact, as I said, the guide says to send a templated email of the 3032, but people later in this thread have indicated that they're having better success doing what the operators told sld to do. Sign, scan and email the actual form. He's also allowed to report back on what the results are.

I enrolled in EP and attached a singed 3032 form in PDF format with the OPTIN email. It worked. The agent told me not to attach any file with the OPTIN email, but I found in the answer in the forum and followed what people suggested here. I sent OPTIN mail in my (petitioner's) account, the beneficiary never get any email from NVC although I've let them know his email. I also saw a thread saying that template email of 3032 sometime get accepted sometimes not, maybe just depend on the agents. A lot of things we are unsure, just have to do it the most formal or best way, maybe have to try a few ways the same time.

Sadly, I'm not eligible for the OPTIN stuff, but I think it's good advice. There are generally multiple ways to do something correctly.

I wouldn't worry, I haven't done my taxes yet and I sent in my AOS a week ago. I can't efile because we're doing married filing separately and I called the IRS to verify that he didn't need an ITIN. As such, we can't efile. So, I'll have to print out my taxes is the next couple weeks and mail in. I would anticipate they'd be ready around the interview date.

Um I haven't filed for the past three years  , so I sent in 2010, 2011 and 2012 returns all together and according to fedex they were received by the IRS n Jan 30. That's what I mean by should I wait until I can confirm with IRS that my returns have been processed?

Didn't efile b/c filing married/separately and so that's not an option.

Gotcha. I would think... but I'm no expert, that you could send in copies of your returns, similar to others who haven't provided transcripts, but copies of the returns.

Ok well see then here's my real question: Do you think that NVC somehow processes the returns and therefore liaises and/or asks for any information from the IRS? If that's the case and I sent in my returns that weren't exactly processed completely, then the AOS might be rejected, right? Or do they just look at the returns and check off that they've received all the necessary paperwork and move on?

Do I think that two arms of the government communicate with each other that effectively? No. Having worked in local government, I've seen how processes work. Having had to obtain Medicaid and Public Assistance benefits for my clients, I've seen this first hand. Those services are intrinsically linked. NVC and the IRS are not. Do I think that someone might find it odd that you didn't file for three years and are suddenly doing it now, perhaps. But my bet is that they've seen it before.

Did you send in tax transcripts or have solid proof of income from the joint sponsor? If yes, that's what I think they'd be looking at more closely.

Hi folks,

Does anybody know whether a change of employment prior to the interview would effect the I-864? let's say the petitioner (sponsor) would take a job offer at a different company than the one indicated on the I-864, what needs to be done if that happens? just bring an updated G-325A to the interview?

It is the I-864 that would be affected by this. He has to prove that he can support you and that is based on his current income and proof of said income in the form of paystubs and letter of employment. Is he going to be there long enough by the time of your interview? I personally would ask my spouse to give it a couple more weeks before leaving one job for another. Especially considering your interview will be in the next few weeks. That's just my opinion but I wouldn't want to take on that risk.

I actually did some research and I would only need to take a new I-864 with a letter from the new employer and if any paystubs are available at that time, I would only present it if they ask for it. I actually found a few Canadians that went through the same and the CO didn't care for the new information/or simply updated their papers with the new employer. It's not for sure but if it happens we can't push it back, it's a once in a life time opportunity.

Well there you have it then :) I was right about you needing the I-864 and new proof ;)

If it's one of those opportunities that you just can't turn down then obviously it's a no-brainer! Everything will come together the way you need it to!
