thanks saylin! so i got the case#s, iin and sent ds-3032. where can i find invoice aos bill? in payment portal right? so now, my husband(usc) filed i-130 for me and for my daughter. we only knew just now that she qualified for crba. we have our sched for crba interview this feb 28. are we going to wait for the results before continuing my visa petition? since the aos bill is $88 per case so my husband needs to pay two $88 ryt? and how can we cancel or withdraw our daughter's case? thanks saylin!

Yes, the AOS bill will be invoiced in the payment portal.

If the two cases are joined at NVC, then it's only one AOS fee per case. It's the IV fee that is per person.

If you need to cancel a petition/application, then call NVC and ask them what to do.

Hello VJ friends,

I asked this question in NVC forum but not much activity going on in that forum so I am asking it here since you're all recently going through NVC process. In our case, my husband will be sponsoring his mother now that I-130 is approved. His income is well above the required level so he does not need my help in meeting income requirements to sponsor his mother. Also, he will not be using any of our joint assets (bank account, property, etc) to meet the income requirements. But, we are confused whether we need to file I-864A along with I-864.

Reasons we think I, as a spouse and household member, needs to fill I-864A:

1. We file taxes jointly. If we use his income alone on I-864 form, those numbers will not match up the gross income stated on IRS Transcripts. Concern here is that this will trigger RFE.

2. Someone on VJ pointed out that NVC wants to ensure that spouse is aware of the promise/contract the other spouse is making with I-864 and therefore they prefer one of the spouse to file I-864A such that the other spouse is aware.

Reasons we think I do not need to fill I-864A:

1. In the first page of I-864A, following is stated. "Form I-864A may only be used when a sponsor's income and assets do not meet the income requirements of Form I-864 and the qualifying household member chooses to combine his or her resources with the income and/or assets of a sponsor to meet the requirements." This sounds like we don't need to fill out I-864A.

2. To support his individual income, we do plan to send evidences such as his W2s, pay stubs, and employment verification letter. So even if the numbers do not match up, the evidence will match the income numbers in I-864.

If your income isn't needed, then an I-864A isn't needed. It's only needed if your income is required to meet the poverty line for the household size.

Filing taxes jointly isn't a problem. Your husband would just need to include his own W2s along with the tax transcripts to point out his own individual income. That's it.

For the DS 230 the only things I need to send a photocopy and original in is the marriage certificate and birth certificate, correct? Also do I need to photocopy the translations of those 2 items also?

There's also divorce certificates and military records, if applicable. And the original police certificate is required (no photocopy needed though as you won't ever get this back). I believe they keep the translations. If you want them back though, then include photocopies and request the originals back at the interview (if they don't give them to you). Not sure about translations as all of my documents were in English (or both English and French).

Thanks for your response....Oohpartiv!!!!smile.gif

That is the same automated nonsense that all the operators tell everyone. There's no telling WHEN your case will get approved, but it could take up to thirty days.

Thanks for u r response Saylin.....smile.gif

All operators give an exaggerated time frame. Don't worry about it. Just keep calling every single day.

Well, you can only start an expedite request AFTER a case number has been assigned, so you need to at least wait until then. Once you do get a case number, call an operator and explain that you want to send in an expedite request. They'll explain what you have to do.

Keep in mind though, being pregnant usually doesn't constitute an expedite. It'd have to be a high-risk pregnancy, and even then... But it's always worth a shot! If the request doesn't get initially approved, just go through the NVC process as quickly as possible. Once you have an interview date assigned, you can try contacting the embassy directly and requesting for an earlier date. Again, there's no guarantee.

When showing NVC the steps taken to re-establish domicile in the US (filling from abroad), I read about showing quotes from moving companies.

But I wonder if actually going ahead and moving all the family belongings during NVC process (ie before getting approved) would be too much?

Could it be an ever stronger proof of going back to the US or would it looks like we're getting ahead of ourselves without waiting for the official approval?

Thanks

I just went online and got some quotes from a few different companies. I don't actually plan on moving my stuff, but it helps proof domicile and the quotes are free. If you want to send your stuff back, that's up to you - I don't think they would deny you or anything for moving your furniture to the States. But if you were to send it all ahead of time, what would you have in your house to cook/sleep on, etc?

I plan on living out of a suitcase and some basic stuff I would sell or throw away at the end.

Mu husband (we're living abroad together now) will probably go back to the US a little bit ahead of me, so I'd like to be able to fly to the US as soon as I can after getting the visa.
