Nope, we haven't even gotten our DS3032 acceptance yet! And then we'll have to wait another few days for IV bill invoice, so I'm really crossing my fingers to get it today or tomorrow. Monday is a holiday so I'd like to get this out of the way before the long weekend. Fingers crossed. :wacko:

Stupid question, if my husband is the only intending immigrant, and my income is my sole sponsor, I should use the I-864EZ? Why have I only just discovered this form right now? That last question was rhetorical. The first was not.

Please, help with the right selection of AOS (I-864) form.

I am a USC, petitioner who filed for my spouse and our 2 kids under 3 years old.

I get my income from W2, and i am the only sponsor and earn enough to pass the poverty limit.

Should i file a separate I-864EZ form for my spouse, and each kid ?

05/09/2012 - NOA1 hard copy received
10/18/2012 - Became a USC and called USCIS to upgrade cases to IR-1/CR-1
10/22/2012 - Got the notice of case upgrade to IR-1

No, the instructions for the EZ form state that you can only use the form if there is only one intending immigrant and your income is the only thing you are using. If you have 3 people immigrating, you have to use the regular 864.

Interesting statement, but it looks like the instruction page #3 for i-864EZ does not say that. :bonk:

I have quoted an extract below:

If the person that you are sponsoring is an immediate relative

(spouse, child, or certain parents of USC citizen), You can automatically check this box "Yes", because

every immediate relative has his or her own visa petition.

But the 864, all types, is based on household size. So your household size would be, I'm assuming 4 because of your wife and 2 kids. I'm no expert, so please don't go based on me, but if they were all on one petition, it would appear that you use the I-864. Again, someone who knows better should have more information. I only have a husband and no children.

ErinBeth, i am not biased against your statement. So, please don't understand me wrong.

I am just trying to clarify this for myself as well as for every person who might be in my situation :unsure:

I have separate i-130 petition for each family member (for spouse, and 2 kids).

Thus, as far as i am having my income from a W2 and i am single sponsor,

it seems correct to file three separate i-864EZ forms. If NOT , please let me know why? :blink:

my attorney's assistant finally sent me the two packages she sent to the NVC, and I noticed she only included my hubby's 2011 tax return stuff (so tax return + W2) do you think we will get a checklist for not including 2010 and 2009? I don't know why they only sent in one years tax return :blink:

Have you received your IV bill invoice yet? I'm pretty much waiting as well. We received DS3032 acceptance email on Feb 7th and it's been 4 days now yet we haven't gotten it yet.

My IV bill was invoice (02/12) 3 days after DS-3032 accepted, And it took 2 days to show Paid.

Well, my husband said and I agree that one year (most recent) tax return is enough. Earlier years are optional. And also pay stub the most recent one is good enough. Employment letter is not necessary, it's an alternative to pay stub. And I've read I-864 instruction, government website's checklist for I-864, to make sure I was right.

You can use the I-864EZ if you wish (it's a shorter, thus easier form), but you're not REQUIRED to if you're eligible. There's simply just the option to.

You either send the most recent one or you send the most three. So don't worry!

Hi guys, I don't think employment letter is a must have once your have tax return and pay stub.

In AOS checklist, it says:

Verify that evidence of current employment or self-employment such as a recent pay statement or a statement from your employer on business stationery is attached. And also in the I-864 instruction pdf file, in Part 6, 23,it states clearly that you may include a recent letter of employment, you are not required to...

Employment letter may take some time to get, so it's not necessary to waste time on that. Pay stub is a good alternative

If you are asking about stuff for your particular case, chasing an IR-5 for your mother -

REMEMBER -

that casefile is headed to Guangzhou IV, and they want to see a good AOS set. NVC isn't going to give you much input about it, when you call in and it's GUZ IV that handles the final adjudication .

So, whatever ambiguity you think is there for your situation or in the instructions - don't second guess it, aye?

Current Annual Income must be validated. If you don't work and your husband is part of the joint-sponser stuff - you'll need info on HIS current annual income. Tax data is for prior year, not current year.

So, however you are choosing to prove-up current annual income - pick a path and stick with it, aye?
