Born Abroad: Daughter of a U.S. citizen

Hello, I just got back to the U.S. and I'm about to file a 1-130 for my foreign Spouse to lives outside the country. She recently gave birth to our daughter which I was lucky enough to attend. During my stay I filed my childs birth abroad and applied for her passport and SSN at the U.S. embassy. The consular I spoke to said everything should be mailed to us within 5 weeks.

I was wondering that since my daughter will have her birth abroad certificate and passport is she good to go for coming into the U.S. when her mothers paperwork finally clears ? Or do I also have to file an I-130 for my daughter as well ? The wording on the immigration form guides mention nothing on these circumstances.

Thank You

She's a US citizen. All she needs is her US passport to enter the US. You do not file an I-130 for her under any circumstances. There no reason a US citizen would need a visa to enter the US. US citizens are entitled to enter the US.

You don't have to file i-130 for your child.

Instead, you file a Consular Report of Birth Abroad (CRBA) and apply a US passport for her.
