Moved from IR-1/CR-1 Process & Procedures to Adjustment of Status from Work, Student, & Tourist Visas forum. OP indicates in this thread that they are adjusting status.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The above contains conflicting statements.

First, she must determine whether she was required to file for each of the applicable years. If she was required to file for any of those years, she must do so. For any years she was NOT required to file (usually because of income below the filing threshold) then she can simply hand write, "Income below filing threshold." on the applicable line of the affidavit. She'll then sign the affidavit, so no need for a separate statement.

She MUST accurately and honestly execute a properly completed I-864.

So, i should file an affidavit of support for my wife but fil only the blanks that i can (like name,address etc.) provide the 2 pages of the IRS law that she is an exemption and at the same time write a statement that she was not required to file taxes.

Am i correct?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The US Citizen petitioner can simply hand print in the space available for prior tax return information, the following words. "Not required to file. Income below threshold." There is no need to provide the law. Consular Officers will understand the meaning, because there is a joint sponsor.

It sounds like YOU, are the foreigner, so no, you do not file any affidavit of support. The US Citizen does.

It sounds like YOU, are the foreigner, so no, you do not file any affidavit of support. The US Citizen does.

Your wife and the joint sponsor will both fill out their own separate I-864 and provide all the supporting documents pertaining to their forms.

You should carefully read the I-864 instructions. Your brother will fill out an I-864. The I-864A is used for a qualifying household member that resides with you to combine their income with yours to meet the 125% requirement.

On part 1 of your I-864, you would check a. Your brother would check d.

Greetings Everyone.

I am a male European Citizen who came to the US on December 29th 2011.

I am filing papers now cause i got married to a US citizen.

I came using Visa Wayver (ESTA)

I dont have the ESTA with me i just have my passport so i took a photocopy of my passport page with the ESTA stamp.

I would like you to tell me what should i put to the following gaps.

1. FORM I-485. Page 1 it says: C/O(in care of).

2. I-94(if any)

3. Current USCIS Status.

4. Expires on (mm/dd/yyyy)

5. Non immigrant Visa Number .

6. Consulate when visa was issued.

7. Date visa issued (mm/dd/yyy)

Thank you in advance.

Ps. this are my last questions so i really hope that after your answer i will file the papers and send them to the immigration.

What do i do,how am i supposed to file it?

(i mean my wifes one that she did not file taxes for the past 3 years and she did not make more than $9700)

I am very confused on why your wife does not need to file when she gets not more than $9700! I get 4600 every year as an income (which is below 9700) and every year I filed for taxes. And every year, I would get back the money that they originally withheld from my paycheck. I am very confused, as I thought all my life that even if an income is low, we have to file we'll just get the money back that they wanted to tax us on. I've been filing taxes for the last 5 years with this $4600/year income! Each year I've got back my money that was removed for tax purposes, but I did file both federal and state. Indeed, I've got back both the federal both the state tax money. So, although all in all, I did not have to pay tax in the end, but I did file.

Anyway, you are the foreign national, and USCIS wants to make sure that the US citizen who is petitioning (asking USCIS) to grant you permission to live in the US as a permanent resident can support your butt in case you do not get any job options out here. USCIS wants to make sure your wife can really live with your (financially) and support you even if you sit at home on the couch sipping coffee. Listen, I have an advices. Share these form with your wife. You may not understand the form but she is a native English speaker I assume, so she should understand and stand up on her feet and do it.

she has not file taxes and she wont file taxes for the last 3 years till september.

i have a joint sponsor who provided me with all the papers that the immigration asks for and of course he filed and signed the I-864.

Now that my wife has not filled taxes and she is not going to file since september i need to file the papers correct,send them to them and procced.

I have the law in front of me (a friend who is an accountant gave this to me) and it says that she is not obligated to file taxes.

If i send the papers tomorrow to the immigration without sending affidavit of support for my wife but i just send all the other papers what is going to happen?

If mt wife has to file without providing them with tax returns how am i supposed to do it?

I'm trying to reply to ur questions as per as my knowledge. First thing first, when you came to USA back in 2011 did you come here as a visitor or student or some thing else ??

1) C/O stands for care of as you know so write your spouse's name or just write N.A

2) When you entered the US, did the immigration guys put a I-94 stamp on ur passport ?? If yes, then you would find your A# (Alien Number) written over there.

He entered on VWP and is adjusting status, not on the K-1 at all....
