Filing Taxes Jointly

My husband and I were married last year and are currently at the very beginning of the CR-1 journey.

I would like to file my taxes as jointly this tax season but have some specific questions.

My husband has already been to the U.S. and worked in the past so he already has a SSN.

His job in India does not provide him with paystubs. He gets paid in cash.

Since he is not receiving paystubs will this be a problem when I claim his income on my tax return? Note: again this is his job in India where he is currently residing.

Nope, there's no requirement for foreign income that requires you to prove how much you made. Just make sure you fill out form 2555 to exclude his income from being taxed.

Thank you so much for the information! Even our accountant was puzzled by my questions.

Just to be clear, the form is for my husband right? Because at the top it says its for U.S. citizens and permanent residents only and my husband is neither yet since our I-130 is currently pending.

Yes but when you file jointly you're choosing to treat him as a resident. http://www.irs.gov/pub/irs-pdf/p54.pdf On page six it details how you do this. That link should answer most of your questions, you might want to give it to your accountant also!

I'm in the same boat as you are, somebody mentioned about ITIN number. Im trying to find more info abt it,called IRS and the lady couldn't help me much and just read out whatever was on the website. They have made changes to this procedure,might not apply to you since your husband has active SSN no.
