Hi, I had a few questions my cousin who has been a LPR for the past four years wants to bring his wife and child to the U.S. I was wondering how will he be able to do this? His wife and child are in Mexico. I advised him to wait until he becomes a Citizen but he wants to file ASAP and if and when he becomes a citizen some how expedite this. right now I told him to have his wife fill out the G-325a, but any help from you guys would be extremely appreciated. Does he have to pay two filing fees for the I-130? two separate I-130? Thanks in Advance!

The process paperwork wise is exactly the same. Follow the guides here for them. One file for each one fee for each. The difference is that a USC filed petition goes immediately to the embassy and the LPR one must wait in line for a visa number to use to bring them which takes about 2 years. If he becomes a USC then the petition is taken from waiting for a number and is sent to the embassy.

This will not be over quickly. You will not enjoy this.

Your advice to wait is bad advice. He can file as an LPR and upgrade the petitions when he becomes a US citizen.

As an LPR, it's one I-130 for the wife. The child is included. There is only one case, so one fee.

When he becomes a US citizen, he has to file separately for his child and pay another fee.

So you see, your cousin is correct that waiting is the wrong choice. He should file now.
