Hi all,

I am completing my I-751 and noticed that it expires tomorrow. My packet is ready and I am planning to send it out tomorrow or Friday. Now I wonder - should I wait an extra day since the form seems to expire tomorrow. They may reject my application because I did not use the correct version of the form.

What do you think?

My timeline:

1997 -------- first time to USA - B2 ("California Dreamin")

1998 -------- Student - F2

2001 -------- Internship - OPT ("Howdy")

2002 -------- First job in USA - H1-B

2008 -------- change to E-2 visa via company

2010/Aug ---- Marriage to USC

2010/Sep ---- honeymoon Costa Rica

2010/Oct ---- Assembly of package (I-130, I-485, I-131, I-765)

2010/Oct/27 - DAY 01 - package arrived in Chicago ($58 FedEx Overnight charge)

2010/Nov/1 -- DAY 6 - NOA via Text and Email + checks cashed by USCIS

2010/Nov/5 -- Day 10 - NOA hard copies arrived

2010/Nov/6 -- DAY 11 - Biometrics appointment notice arrived

2010/Nov/23 - DAY 28 - Biometrics Appointment in Fort Worth, TX

2011/Jan/3 -- DAY 69 - YESSS - Interview Notice received in mail - Interview set for Feb 4, 2011

2011/Jan/8 -- DAY 74 - AP arrived in mail. 2 copies.

2011/Jan/13-- DAY 79 - EAD card in mail.

2011/Feb/4 -- DAY 101 - Interview Day - office closed due to snow/ice in Texas.

2011/Mar/10 -- DAY 135 - rescheduled Interview Day. No official approval communicated, but told that card will arrive in 2-3 weeks.

2011/Mar/29 -- DAY 154 - Scheduled Infopass appointment for Friday 4/1

2011/April/1 - DAY 157 - Infopass App in Irving, TX - was told that a decision has not yet been made about my case

2011/April/14 - DAY 170 - 30 days since my interview: Called USCIS - was told wait a 30 more days.

2011/April/25 - DAY 181 - Green Card arrived.

Its not very likely they will have a new form the exact day the form expires. Send the one that is available.

I dont think they have a new form published yet.

I am not sure whether it would be OK if you ship it by the expiration date but I had a bad experience with an expired I-485, back when I was going through AOS. They took a while to send it back. Unless someone here is absolutely sure that you'd fine as long as you send it by expiration date (tomorrow), it wouldn't hurt to wait a few days to see if USCIS publishes a new form. You could also call USCIS to confirm.

usually even if the the form expires , they will keep using it until they announce it's no longer used !! so after they publish the new one If they do so, sometimes they keep accepting it for a year or 2,,, don't even think you will have a problem.

Edition Date :01/12/11. Previous editions accepted.So I imagine they'll keep accepting the current form for quite some time even after the new one comes out.

i have just called uscis and spoken to this woman that works in the forms department. she said that the 1-751 form is still good after 01/31/2013. so anyone that is going to file after 01/31/2013 still can use this form that says expires on 01/31/2013. i hope this helps.

If you notice that the corner that has the expiration date also has OMB for office of management and budget. This is the department that controls the forms used by the US government and they have a procedure for printing forms. That procedue includes regular updating of forms. To know if the form is the most recent they issue an expiration date. The department that actually uses the form decides which versions are accepted and they do this by stating the expiration date. So you go to the USCIS website to see which versions of the form they will accept because they may not have given the OMB the new version of the form because there are no changes so they will state on their website that the I-751 form version 01/31/13 will be accepted even if the current date is say April 23, 2014. It just means the USCIS is slow in updating their forms just like they are slow in processing applications.:wacko:

As the other posters have said, use the form even if it is "expired".
