Need some help(don't move yet, I have friends in this Forum)

I know this is an immigration issue, but since I spend so much time here now, I figured I'd get a quicker response. Ok, here's the situation:

One of the sailors here just came to me and asked for my advice. He just married his wife like two weeks ago, and she is two months pregnant with is his kid. He is a USC, and she is a Mexican citizen living here illegally for the last 6 years. He is balancing a decision to either file for her or just get her a military ID card and keep it moving. Also, she is using a SSN that isn't hers. I am not too immigration savy on some things, so I am asking the experts. Any thoughts or course of action?

If he married her in the US, and she entered the US legally, she can adjust status while remaining in the US. Otherwise, she needs to return to Mexico, and he has to petition for her visa. I don't know what the military's policy will be if he married a non-citizen while in the military.

She faces a ten-year ban, but will probably get a waiver. Complicated. Very complicated.

Usually any illegal presence is forgiven once someone marries a USC. In my opinion, they should be ok to file for her AOS. Make sure they have a trail to show their relationship is legit. Her carrying his baby, would help with that.

I concur, she didn't come in legally, so I know the ban is an issue for him since she is pregnant with his child. I also told him using someone else's SSN might be an issue as well. He brought up using an immigration lawyer, I said wait until I check here first.

No, he needs a lawyer. And whatever happens, she shouldn't agree to leave and wait in Mexico.

I don't think the fake SSN would be an issue either. I would definitely recomend he talk to an immigration attorney if not hire one.

Ok, I will let him know. I hope she can stay here, that will be hard on him if they make her leave.

Agree, under no circumstances should she leave the US, unless she's deported.

A legit marriage to a USC will forgive many things.

The fake SSN is a BIG deal depending on a few factors. Did she just "make it up"? Is the SSN a USC's? If is IS she could be facing a charge of pretending to be a USC which is a lifetime ban with no waiver. I've read about that before.

She needs to see an attorney, a good one, asap.

It is never a good idea to just "let it go". It could be now that she gets deported, or it could be later. Either way he may or may not lose her and his kid. He either needs to deal with it, or live in fear of losing her or them down the line.

I just came from over in his office, he is getting her added to his dependent page 2. I told him I would get the advice from here, but I also told him what could happen if he got caught. I beleive it's someone else's SSN and that's the part that scares me, I told him that could get her a lifetime ban on that alone. He needs to tread carefully.

my uncle was married and has two children with a woman from honduras. they are now divorced and she goes back and forth from the us to honduras regularly (she has children there as well). during the course of their marriage she sold his ssn number and also used stolen ssns to avoid paying income taxes on her income. i don't know all the particulars but she still has her green card (obtained through marriage to my uncle), she's never done any jail time, no ice threats at all and she travels freely.

Ouch, I hope it never gets that bad. But it's better to do the right thing rather than not.

well, i figured i'd put that scenario out there considering that my uncle's ex was clearly contributing to criminal activity and yet has been left alone by immigration.

i definitely think he should do things the legit way for their own sanity and future, i'm just not certain that the whole ssn issue will be a problem. it is possible that it won't be. of course, there's really no telling. if i were him i would keep my options open as far as where i planned to reside in the future.
