Hello Again,

I just got my GC but had to travel back to UK from USA to sort some things out and also marry my boyfriend he is Irish and does not need visa to travel. My question is: after we get married and I will apply for his GC can he travel to USA as before while waiting on his GC to processed?

How did you get your green card?

He cannot enter to immigrate without an immigration visa. However, he can visit you, and if on one of his visits he decides to stay, then he can choose to do so and adjust status.

He cannot enter with the intention to stay, though.

If he does not have ties to his country (return ticket to UK, job verification letter, NOA1 hard copy, pay stubs, rental agreement), the US CBP officer will turn him around at the border and send him back. They will not let him into the US until he can get his immigration visa if he has no ties to his country.

Ties show that he is intending on staying in his country until his immigration visa is received. Could be a couple of years for a permanent resident filing for spouse. If you become a citizen, then you can change the status of his petition, and he will be approved faster.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Incorrect information, if the LPR just got her GC, than a visa will not be available for the husband of a LPR until 2 years later. There is a wait on visa avavilable for spouse and children of GC holders.

I told her it would take a long time. I didn't say that it would be quick.

In the future you should just say "To clarify" instead of "Incorrect."

yess, he can visit you as a tourist. but don't over stay. if he over stay when his petition is in process, it might jeopardized the petition. be careful, be wise..
