If mom visited for 6month, can wife apply for I-485

Timeline

Hi all,

Hope someone can answer some of my questions. Let say my wife become a US Citizen in July 2013. In July 2013, her mother visited her for 6 months. During her mother visited, can my wife or will it be possible, for her to file I-485 and at the same time file I-130? Or my wife had to file I-130 and mother had to go back to the country when visited reached 6 month time frame?

1/05/2009 Sent I-129F, G-325A + other documents as required. $455 fee
1/09/2009 NOA1 Petitioner received
4/30/2009 NOA2 Petitioner received (approved in 105 days from NOA1 3.5months)
6/08/2009 Packet 3 Petitioner received
6/20/2009 Packet 4 Petitioner received, mail everything from above forms & I-134 plus other doc as required for beneficiary
7/23/2009 Interview @ 7am, Interview passed- visa pick up July 31st

9/15/2009 Applied for Marriage License $40
9/29/2009 Applied SSN (bring SS-5, Passport, & I-94). Went to local County District Court for Marriage License $38.50 fee... Officially Marriage. Received SS card in less then 2 weeks. 2 weeks later, apply for State Photo ID

12/17/2009 I-765 Approved
12/22/2009 I-485 Approval letter/Welcome to America

Timeline

are you asking that if your wife's Mom visits the month after your wife becomes a citizen can she file adjustment of status for her mom? The answer for you would be no. Traveling to the US with a visitor visa with the intent for your mother in law to adjust status and stay in the US is visa fraud and illegal. Since you just asked this question, it is clear that would be the intent. You wife can file the I130 while her Mom is in the country, but her mother must return to her home country for the interview.

Ok just asking since i must misunderstand on the guide on mom stay in US lol.. no intention for fraud & illegal, don't want case to be any harder. :)
