Hi,

This topic has been discussed many times before and from what I've read, there have been many suggestions as to how to file I-130 (for a green card) form for a spouse that does not have a last name. But unfortunately, there has not been any confirmation as to what works and what impacts there are on getting the SSN or driver license later on.

The following are what I have come to know so far. Assume my wife's name is Jane.

1. Writing none or NONE or No Last Name Used or something similar in the last name box. My concern here is will USCIS issue the green card later with Jane none or Jane FNU? I suppose the USCIS does this, my wife name will be weird. If USCIS issue the name with just Jane, I think that would be good.

2. Writing N/A in the last name box. Again my concern is the same as #1.

3. Another interesting suggestion is to put my last name as her last name and in addition to that, put Jane (her first name only) under the Other Names Used box. My concern is whether this is acceptable to USCIS and State Department. Will there be any issue since all of her documents only have Jane?

I appreciate it if someone can share their experiences.

Well what name does Jane want to appear on her GC? What ever you fill the 130 out with is whats going to appear on her GC.

So if shes taking your name Jane Smith, youd fill out the top as Jane Smith and in other names used, enter Jane. If she wants her GC issued as Jane. then youd fill out the top as Jane.

it involves filing the 130 with your last name, having the GC issued in that name and changing her passport all before she gets here.

Scenarios 1&2 involve her obtaining the GC in the name Jane no last name. If she does decide to take your last name once shes here, you will have to pay to get another GC issued with the new name on it. Lots of people do not have a middle name and write --- in the space for middle name or no middle name and I dont think there has ever been a post where someone said OMG USCIS printed me a card that said Jane No Middle Name Smith or Jane --- Smith.

I do think though she is going to have issues with SS and DMV and banks amoung other things in the US with no last name as most people have last names and the workers are not going to know how to handle someone with no last name. The computers may reject it, and you may have to get supervisors involved. I hope youre a patient man.

I am dealing with the same "no last name issue" and wondering the best way to go about it.

As capri said, coming to America with no legal last name just seems like it will create a lot of inconvenience and difficulty later on - SSN, driver's license, accounts, any legal documents really...

My husband is from India and his "surname" is apparent on most documents but it is not his legal "family name" (just his full given name, as is common in India), so his passport lists nothing under surname.

Would it work to just file his I-130 with his surname? I'm just worried of doing everything and then getting held up or rejected somewhere down the line because his passport name doesn't match his application. Maybe I'm being paranoid?
