I have been separated from my wife for close to a year now and my divorce will be final on 02/11/2013 . On my letter of intent I am putting down the date of 02/12/2013 as I will be legally able to marry and it will be a truthful letter . State of Florida has no laws or waiting periods for marriage just after divorce (whew). My question is for my fiance' does her date matter ? I'm thinking no since she is able to marry at any time being single . Just want to make sure about that before sending the packet to USCIS .

Also my previous wife was Filipino and we filed an I-130 for her . She was living and were married in the U.S.A. . The interview went smoothly (like 2 minutes) and never had any problems such as home visits or any other interviews . We will be married four years this 02/04/2013 and divorced as stated on 02/11/2013 . The marriage was a true marriage that just did not work out and we have gone our separate ways . I filed for her two children and that went smoothly as well . What problems may occur while filing for my fiance's now in the Philippines ? This is only my second time and I know that it is acceptable with the USCIS . I would imagine they would take a closer look since this is my second time . Also how do I get the dates I originally filed for my wife ? On the paperwork I have just the month and year of the filing . My soon to be ex has all the copies and I have not informed her of my future plans of fear she may become disgruntled and slow the divorce . I am praying everything goes smoothly with the I-129F as I faithfully filed the I-130 truthfully and have the evidence to back that up if needed .

The potential issue I see is you said you have been separated a year and want to file as soon as you are divorced. How long have you been dating your fiance? This is a pretty quick turn around from marriage to marriage and could cause a red flag you may need to address.

The fact it is a second filing should be no issue.

The potential issue I see is you said you have been separated a year and want to file as soon as you are divorced. How long have you been dating your fiance? This is a pretty quick turn around from marriage to marriage and could cause a red flag you may need to address.

The fact it is a second filing should be no issue.

I was fully aware of the red flag this would appear to be to the USCIS . Honestly the first marriage was a true marriage that was really a mistake on my part . My wife has had many issues from her past that just causes her relationships to fail time and time again . Something I wish I found out earlier , but everything happens for a reason . Did she have other intentions not known to me ? Honestly I do not know , but I know in my heart that I married her out of love . We were married four years , but the last three were just really bad . So yes been apart a short time , but my heart has been away for many years . I was in a point in my life that I was lost to be truthful . Out of nowhere I decided to attend church on Palm Sunday and found God on that April 1st . Since then my life although changed a great deal went through a rebirth . I left New Jersey and moved to Florida and since my life has been blessed and favored by God . We all know how long this process can take and waiting even another day just can't be done . God is with me and is guiding my life and opening the doors needed for me . Everyone has their own beliefs and this one is mine . That is my faith and it keeps me strong .

I met my girlfriend (fiance') on 07/10/2012 and she was fully aware of my situation . I decided to take the leap of faith and fly to meet her on 09/18/2012 . It worked out wonderful as she is also a woman of faith and we share the same qualities together . I encourage her and she does the same for me . I feel very blessed to have met her and thank God everyday for it .

This is a wonderful site for many people and the help here is so great . This is a struggle for many and being a part from your loved one is very painful . I am so thankful for being guided to this site and hope to be able to help with others as well . Yes very quick red flag , but in my heart there are no such flags . To my journey and to yours Gods speed !

What a beautiful story in the end! I am truly happy for you. What it boils down to though is the red flag still exists. Just make sure to be prepared for it. Get lots of proof of your relationship, etc. and make sure she is prepared to answer questions in her interview regarding this issue and hopefully all goes well! In the end this will all be worth it, I promise. :star:

We have the same situation, my fiance's divorce was finalized mid-June 2012 and we filed for I-129F last week of June. We got approved and I just got my visa today. :)

As long as both of you are free to marry when you send the petition, you are good to go. :thumbs:
