need proof of ties to country

My brother in law has to proove ties to his country in order to come here for studies. He does not own anything and does not have a bank account. He works but doesnt show income b/c he works at a cyber cafe. Does anyone have any suggestions to show the consulate he has ties home and will return after his studies? I know this is a big thing for visa approval for the consulate. Any suggestions please!!!

1. A visitor must demonstrate to the satisfaction of the consular Officer that he or she is entering the United States for a temporary period of time. The visitor plans to leave when the visa expires and does not intend to stay in the U.S. permanently. The visitor must have a round-trip ticket as proof of intent to depart upon the expiration of stay, and that he or she has sufficient financial resources for the trip. A letter from the employer describing the nature of the trip is recommended for B-1 entries.

2. Proof that the visitor has a residence outside the U.S. that he does not intend on abandoning, shown via deeds to real estate or an apartment lease. These help to persuade the consular officer that the visitor has strong ties to his home country and is likely to return after the trip to the Unites States.

3. Proof that the visitor has sufficient financial resources to take the trip to the United States, which may be proved by such documents as bank statements, as well as proof of employment to which the visitor intends to return. In some instances, an Affidavit of Support may be required, submitted by the person in the United States whom the visitor is coming to visit.

The only way you can show intentions to return is with a significant amount of money in the bank, or his family having money. Plus, you cannot get a student visa without a letter from the family bank signing off that there are funds to support the student from Morocco. It is not acceptable for him to show someone in the US as his support. This also proves he intends to return. Keep in mind foreign student fees are far more expensive, plus housing, food has to be shown to be able to be paid directly from Morocco. This means teh letter from the bank would need to show the family has about 5 times the yearly tuition & room & board in the bank.

My BIL went to school here. His father had to renew his bank letter on file with the school & UCSIS every year. Plus, the student visa is only good for 2 years, I believe, so it has to be renewed at least halfway through the degree, and you must have been in school 12 units per quarter/semester for every term during the 2 years here, otherwise you will not get it renewed. You also cannot get it renewed in the US, you must return to Morocco for the renewal process.

None of this bodes well for you considering you originally posted that you are just looking for an easy way for your husband's brothers to come here because he is lonely.

I said that????? He was lonley? Well he got the i-20 now and we are waiting for him to get all the document together to go for the interview. I hope he gets approved. He is such a smart man and would do good here. If I could get his whole family here I would love it. There is no opportunity in those countries and here there is so much. We are very lucky even though our government isnt doing so good by them.

I live in a town where there arent any muslims and I would love to have someone from his family here so he wont feel so alone in his religion. He is afraid to go to the mosque here because he thinks they are being watched and he doesnt want any problems

Yes you did. You are unreal. You've been looking for all sort of ways to get his whole family over and haven't been quiet about it. You astound me. We are lucky here, very lucky. But instead of being grateful and doing your part by abiding the laws of this country and allowing citizenship for your husband and in the future, his family, to take the rightful course, you want to bend the rules to your satisfaction. Anyone who really believes your brother in law will be coming over here for 'university' and just to study then leaving in a timely fashion is crazy. I really hope USCIS DOES monitor these boards. You're grasping at every trick in the book.

ahhhhh Hellooooooo. I said ALONE IN HIS RELIGION. Who do u think u are to say "im unreal" Its not ur business. Are you supporting him? Your newly married and your husband isnt muslim so u cannot comment on how he feels. Anyone for that matter. btw im not bending any rules. If he comes here he will be going to school. When his school is over if he gets accepted in another university in sha Allah he will continue. If he doesnt he will return home. In time ,yes we will try to get his family here. Ive been to other countries that are poor and I know what it is like to have no opportunities. The courses he is taking here they do not offer in his country. If he doesnt get approved then he doesnt. There is nothing we can do. He will not overstay his visa if he comes. We and they are not law breakers. We are all just regular people looking for opportunities to make it in this world. Maybe if you payed attention to whats going on in this world you would have more compassion for people. Just my 2 cents

That's what you said as well. In this thread. Obviously you do feel our government should be doing 'good' by them. And our government is me and everyone else who is a citizen of this country. FYI it's not our government's job to do good by them. It's not there government.

Not true. One can easily take their money with them, or send for it afterwards. Having money does not show an intention to return.

As kitkat posted, having money addresses the issue of beinga able to afford the visit that one proposes and showing that one meets the public charge requirements of the law (these requirements apply to all visas, not just K and immigrant visas).

Not to mention she said the brother has already attended 4 years of college but she plans not to mention that at the consulate.

I was unclear by using "money in the bank" I did mean money, property, a business, etc. Certainly cash in the bank does not gurantee a visa without other solid things that would guarantee return. And of course nothing guarantees a visa is approved.

I know exactly what you are talking about, so I can comment. You are trying to work the system. First you posted your husband is lonely in his religion, then you came up with the idea of a student visa althoug your BIL already has 4 years of school but no degree.

Everyone wants their family to be together, but this going around the system muddles it all up for those trying to abide the law. Plus, there are real students out there who would like the system to not get any more difficult thank it is. But people like you doing stuff like this will potentially toughen student visa regs.

To the OP

You should not even attempt to bring any family member here until your husband has earned the right to be a citizen and has paid something into the country that is now his home....

I hope to bring my parents here so they do not have to be alone in the final years of their lives.... but I will wait until I have earned the right to be a citizen before I do anything about my parents joining us here...
