Advance Parole

Hi everyone, we have applied for our K1 visa back in August 2012 and are hoping to be approved in the not too distant future. We want to marry asap (obviously!). My question is... I understand that I cannot apply for advance parole until the day after our wedding but I will have to travel back to England pretty soon after so I can finish my last few months at work (I retire in October 2013). So... can you tell me how to go about an infopass appointment.. can i just sit on the steps of the infopass office the day after im married and beg or what.. how long is it likely to take??? PS will be living in upstate NY and using the vermont office.

You file for Advance Parole (using an I-131) at the same time you file for AoS. The soonest you can file for AoS is when you have a certified copy of the marriage certificate. You should receive your AP within 90 days of applying for it.

Making an Infopass to apply for AP would be for someone with an emergency situation, such as a family bereavement or an equivalently severe situation that was unexpected and beyond the applicant's control.

If you are retiring in 2013 then you are not yet ready to move to the US. AP is meant for brief trips, not for moving home for 10 months. Consider postponing using the visa as long as possible ( 6 months) and retiring before October. Sorry

I see that your filing date is at the end of August, by the time you receive the NOA2 and complete the remaining steps for completing the visa, you will probably have enough time on your visa to continue your job (through October) before the validity of your visa runs out. Your best option in my opinion is to wait to use your visa until you have left your job.

Another vote for this option. Even though you can travel with AP, even if you get it in time I would not risk it- as mentioned, AP is for travel, and you essentially intend to live and work abroad for another few months. If immigration find out (and they likely will), they may not like that.

Just like to say thanks to everyone for your replies.. Yes I guess the best option is to wait until I can escape work! Hopefully I will get another couple of visits in before I actually have the visa and then when I have the visa I can just stay. Makes sense. Thanks all
