I'm not truly sure this forum can offer you anything substantive to help your situation because it is a very complicated story and one that is too easy to judge. If you want to get heartfelt opinions about how to proceed with a visa application or immigration issues from a bunch of very nice people on a free forum, then understand that you will get a mixed bag of reactions.

On the surface, it seems that your fiance has a lot going on. If you know her well and are truly convinced that she has been completely honest with you, then just make sure you two get the best legal counsel you can afford. "Immigration Expertise" -

What really offends/annoys me about this whole ordeal , as someone who sometimes impatiently waited for her turn in this immigration system, is how dead set OP is on making asylum work. SHE IGNORED THE IMMIGRATION PROCESS. She was given an equal chances just like everyone else, and she chose to ignore it, plain and simple

My suggestion is that you learn French quickly if you want to stay with your girlfriend. There are many experienced users here on VJ who have read hundreds of cases.

I have read this whole thread (which I usually never do as I am not the most patient person) and I still can't figure out what it is about!! It's sounds like a action movie scenario rather than a real life situation. To the OP: seriously, people here are really helpful and go out of their way to help others and I am sure they want to help you, but you really do need to tell people the truth, i.e. facts. What you have told people so far really sounds unreal.

The only thing I can assume is that she probably missed the appointment because of the DV scenario(s) occurred around this time and went home out of fear. But then again, she could've consulted an immigration officer before she did anything irrational like flee the country. Then again, there isn't enough info from the OP so I'm just speculating :huh:

France recently passed this law where income over 1M Euros is taxed at 75%: if I was a millionaire, I would be scared of living in France.

Persecution! Perhaps Russia might be a good alternative, I heard they are taking rich defectors from France. ;)

She is seeking asylum from a country that she had been back to at least once since she arrived in the US. Really? This entire situation is a hot mess. Why not just have her return to France voluntarily before she receives a lifetime ban for filing a frivolous asylum claim? You telling USCIS that you want to marry her now, is clearly just a last ditch attempt to keep her in the country. You can get all the sworn affidavits from family and friends you want, stating your intention was to marry her before this all happened, it won't matter. Marry her in France, you can return to the US(leaving her in France) and file an I130 on her behalf. You will need a waiver for her overstay, but at least a waiver is an option for overstay. Hopefully she was smart enough to divorce her first husband. She thought that going on vacation was more important than showing up for her interview way back when, so I'm not placing any bets. You never told us what the domestic violence situation is. So whatever that is, it will only add fuel to the fire. I suggest you come back and explain the entire situation, with the entire truth, using at least punctuation. Oh yeah, ditch the attorney who says she can get asylum from France when she is free to live in any European country she wants, he/she is only trolling for your money. I am still struggling to see how you can possibly think that an asylum case would work in her case...
