Anyone been in this boat before? I dont recall seeing anything specifically requesting paystubs in the I-864. I sent last years tax return only. I earn well above the poverty level guidelines but am now sweating about the potential of an RFE...

Has anyone sent the I-864 without paystubs and been ok? How much of a delay would an RFE on something like this cause?

Unfortunately I made the assumption that this would be mentioned in the instruction for the form:

http://www.uscis.gov/files/form/i-864instr.pdf

First time I have ever seen that link florida4life. Thanks.

Can i pre-emptively send my evidence now? Or do I need to sit back and wait for the RFE? My application was literally delivered to Chicago today.

Just wait for the RFE. The RFE should only delay the case by a week or so.

i agree that 1864 instructions found on USCIS website dont say that paystub is required but i cant say you're not getting an RFE. Is the return you sent a tax transcript from IRS? If you get an RFE, it will delay your case probably two weeks as long as you sent your paystub right away.

Well, 2 weeks is not terrible I guess... Thanks guys.

I printed my return from H and R Block for 2011. I will likely be filing taxes tomorrow, so I guess if I get an RFE I will at least have some fresh documents to send back to USCIS :P

We did not send pay stubs and were not RFE'd. That said, we filed right after filing taxes so it was proof of current income. Did you send a letter from employer? That's on the I-864 page of USCIS where the instructions and form is.

If you are only sending copies of your tax returns you need to send your W-2s as well. That is a requirement.

Well, seems I really fudged the affidavit of support then since all I sent was a copy of my taxes. Here I thought the I-864 was the easiest one :P

Lesson learned.
