Okay so heres my situation i came to the us when i was 5 years old im currently 18 years old. I came on a b-2 visa, i chose to leave to my native country last year because i did not want to accrue illegal presence both of my parents currently live in my native country. When i left the us i left in the middle of my 11th grade year so i did not have a high school diploma. And right now i have recieved an I-20 for an open community college because i dont have a high school diploma to go to a university, in trying to get an F-1 visa with the sponsorship of my parents they own a company here and they also have the right funds. My question is would i have a problem obtaining an F-1 visa because i overstayed? Should i tell the truth about overstaying?

It seems you have done the right thing, you left before you do not have any illegal presence accumulated and it does sound like a tough situation but never lie if asked a direct question. If you are not asked about it, I would not mention it.

Do your parents live in the US or your native country? If they live in the US it may be harder to get a non-immigrant visa.

You should always tell the truth. If you do not and you get some sort of visa or benefit then it can be taken away from you if you are found to have lied. There could also be worse consequences.

Always tell truth... if you are caught lieing the results can be lot lot worse.

During interview everything you say is recorded all your statements would be put in the system and sometimes they can comeup years after those statements are given.

So to make it simple and easy always be honest.

Which country?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

The first thing is, as others have already pointed out, you always speak the truth - more so involving legal and immigration matters.

The other thing is that I'm not following your story right; so here are some questions for you.

You came here at 5yrs old without inspection?

I assume your parents brought you here at 5yrs old? Correct?

Were you brought here legally or illegally?

When did you come on the B2 visa? At what age?

And how long did you stay during visit?

At what age did you choose to leave the US voluntarily?

You state at 11th grade, were you 16 or 17?

Does you or your parents have evidence of you ever living in the US as a child till age 17 or 18 before you left voluntarily? The Dream Act will be worth looking into... If you can answer some of these questions to make your story clear, then I'm sure members can offer better suggestions. On the side note, F1 visas are issued on their own merits provided certain requirements are met. In the mean time though, this is the link to the DOS website about F1: http://travel.state.gov/visa/temp/types/types_1268.html

I would certainly say it is a long shot, but no harm trying.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
