Going to Philippines

I came here on a Fiance Visa and got married and got a divorce, my case is still pending I have not recieved my green card can I fly back to the phillipines.....Please Advise

You can fly back to the Philippines anytime.

But the question is, do you want to go back to USA? Do you still want to be a permanent resident? Did you file for the Advance Parole when you applied for AOS?

I did file the AOs but since where divorce it happened idont have my greencard coz my husband wont come with me in my enterview,,,i dont have advance parole,,no greencar.i just want to go back..is there any problem with this?.thanks

As long as your Philippine passport is still valid, you can go home to the Philippines.

But once you're back in the Philippines, you won't be able to go back to the US since you don't have a proper green card or advance parole.

So sorry about your marriage / divorce. I think since you have no GC it is best for you to come back home or else you will stay illegal in the US which is not the right thing to do. And, remember you could no longer go back to the US with same visa when you entered. Don't worry, just come back home, it will surely give you peace and comfort.
