Hi Guys,

I'm applying for Naturalization end of this coming september. My 5 year anniversary of being a GC holder would be December 2013. I had trips outside of the U.S. which totals to 407 days or a little over 13mos, but in staggered trips. Including an upcoming 5 month trip to prepare for my wedding back in my home country. Here's the breakdown:

Feb 5 2009 - March 25 2009 = 48 days

Apr 27 2011 - Sept 26 2011 = 152 days (5mos)

June 16 2012 - July 9 2012 = 23 days

December 17 2012 - January 15 = 29 days

**April 23 2013 - September 26 2013 = 156 days (5mos)

Total of 408 days *** (13.6 mos.)

I need an opinion from the experts here and those who were in this kind of situation. I need to know if I'll have a problem applying for naturalization. I'm pretty sure I'm way passed the 30 mos. rule. I just want to maker if I'm ELIGIBLE already. Really do appreciate your help...THANKS GUYS!!! :)

Okay,

let me start easy, pretending I'm the I.O.

After getting the introduction out of the way, I'd ask you what kind of job you have that allows you to take vacations taking 5 months or longer per year. If you answer me that you don't work, I'd ask you to show me how incredibly wealthy you are. If you are telling me that you are not wealthy, I'd ask you how you can afford such vacations without having to work.

Depending on your answers, I'd proceed.

Yes, you are eligible to file. It's possible that this will go super smoothly, and it's also possible that the I.O. is not happy with your excessive absence from the U.S. and does what I would do.

hello,

i dont think there might be any problem at all.your interview would be very smooth.no problems at all.if any of your trips were above 6 mnths or close it all,then IO would go deep into those questions.my brother has same time period as yours,he got approved,just take care you file only 3 mnths ahead of your 5 yrs residency application.as yours is dec 2013 you can apply in october 2013.best luck and no worries at all

First of all, thanks for the reply! :)

For my 5mos outside the US last 2011 was because I got laid off from work, so I decided to have a vacay back in the Philippines, and at the same time not lose money from paying rent while looking for a job.

If I.O. asks me how wealthy I am...to support myself in those 5mos outside the U.S., I'd answer back with wealthy enough I guess...I have no credit which is bad...but it's because I don't like credit cards and let alone LIVE through credit cards, I have no loans,I paid cash for my car which is over 20k. SO I guess for the I.O. to consider If I am wealthy enough to take the 5mos vaca before, that would be enough. It's a matter of weather I would spend my money on rent or on vacay...I'd go for vacay... ;) And besides...job hunting nowadays go through online process.

I just wanted to make sure the number of days would be a-okay before I apply. But would you think it's better to apply by January next year just to make sure? Right after my 5 year anniversary? TY!

Thanks for the reply! Hopefully I get through the same as your brother. And I really tend not to even reach the 6month boundary.hehehe I've heard too being questioned deeply about that. Thanks much again! :)
