Hello

I have a quick question regarding income requirements. My fiance is not yet working full-time as he has yet to finish school. He is doing very well in school and the job he is training for can make very good money to those who work hard, which I am confident he will.

However, by the time we file the paperwork for my CR1 visa he won't have been working very long at all. He will probably only been out of school a few months. If he can prove that he has permanent employment and his salary is a certain amount, is that enough to satisfy the proof of income requirement. I read somewhere about needing to show tax returns from the previous two years and he obviously is not earning enough to support the two of us while still at school and doing some odd jobs here and there to get by.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

The taxes for previous years just makes sure that he's not dodging the tax man, and could also be used as evidence for his salary if he is on commission or is a contractor. But they are mainly interested in current income. An employment verification letter with pay stubs will usually suffice. To be sure, he must make sure he files for previous tax years (unless he didn't have to, in which case he can just write an explanation telling why he wasn't required to file).

Job offer is not enough.

But an employment verification letter combined with recent pay stubs will do the job. Good luck to you and yours!! :)

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Thank you for your quick reply.

We are definitely going to wait until he has a job and has settled into it before we start the application process so by then he will have pay stubs and also his employer will be able to verify that he is, indeed, working and earning a regular, steady wage. He would be a fixed employee, not a contractor or commission-based worker.

I have a good job here and although we want to be together as soon as possible, it also has to be the right time to make the move and done sensibly.

I would recommend getting a co-sponsor if you can? My hubby is in a similar situation. He has only just gotten a job which will provide a steady income - but obviously doesn't have much evidence of working this since he was literally just given the position. Even though his pay will be enough to keep up above the poverty line we are still using a co-sponsor. (Hubby's UK visa was denied because I didn't have 6 months worth of pay slips after starting a new job (despite being on a teacher salary) Obviously this isn't a UK visa but better safe than sorry! :)

06/07/08 .. Met while working through Camp America programme in Maryland.

06/02/12 .. Got Married in Inverness, Scotland.

10/11/12 .. I-130 Sent

10/17/12 .. NOA1 date

12/20/12 .. File was transferred to my "local field office" (Baltimore)

02/05/13 .. NOA2 date

03/04/13 .. AOS bill paid

filing and interview day - there's a lot o time inbetween.

Study the span by studying the timelines here for the UK for a CR-1 visa,

then plan accordingly, aye?
