Parole Approved, can I leave and have the wife mail it to me?

I am adjusting my status. Arrived on K-1. My advance parole got approved on the 25th of Jan.

I am in a terrible hurry and I want to leave.

Can I leave now that it is approved and have the wife mail it to me?

I know that they do not ask for it while you are leaving the country.

My Case Status for AP says, post-decision activity. They have just sent me the letter of approval. It might take another week to get it. But I really need to leave.

To leave or not to leave?

I would want it in my hand. I wouldn't take any chances with mail, FedEx, DHL, etc. If it gets lost you will have stay in India and try and work it out from there. Personally, I wouldn't take the chance.

It can be done, but I personally would not do it. Maybe it gets lost in the mail, maybe there is a typo on it, or some other issue that prevents you from using it. I would not want to be stuck outside the US under those circumstances, but ultimately it is your decision.

Are there extenuating reasons why you must leave suddenly? For example a sick parent/relative, etc?? If that's the case, you can make an InfoPass appointment & with sufficient proof they'll likely print or give you something right away so you can leave.

Technically you are allowed to leave the country. If your approval date was the 25th, that's the date that will be printed on your card. My husband & I were in the same predicament before Christmas. He was approved on the 11th & we left the country on the 14th, without the AP/EAD card in hand. The card arrived on the 21st & my mother sent it to us via FedEx Intl Priority. It arrived without any problems a few days later. Keep in mind the card was mailed to Denmark, not India. I'm not sure how reliable mail is to India.

It was a little stressful, we took somewhat of a gamble, but it all worked out fine. The card usually arrives quickly, within 10 days after approval. Can you wait a few more days??

The same FedEx that delivers to Denmark delivers to India so mail safety isn't the issue.

I was concerned about USCIS having a problem with my departure and assuming that I abandoned the petition.

So I need not worry about USCIS at all?

If you've been approved for AP, then you can leave the country and will not abandon your AOS. You will have NO problem leaving the country but you will absolutely not be allowed to return to the US without your AP card in hand and just having a letter saying you were approved will not suffice. If your case number works in the online system, you can get case updates, which means you'll be notified when your card is in production, when it has been picked up by the USPS and a confirmation that is was delivered to your home. FedEx Intl was quick, easy and less expensive than I anticipated.

That's a silly question, yes, of course you do. Keep in mind that your AP card is not a guaranteed re-entry into the United States... If you've had 180+ days of overstay or been out of status you will not be allowed back in. I haven't heard any instances on here of anyone being denied re-entry on AP, but it can happen.

I can completely relate to your situation. I was VERY nervous for my husband to leave without the card in his hand and yes, a million of "what ifs" could have happened, but luckily they didn't and it all worked out fine. Good luck!

This was overruled by Matter of Arrabally last year.

This is not yet settled law, no one should rely on it.
