Hi VJers ! my 2 cousins study abroad and they hold 10 yrs GC . officer in the airport told them to get travel document because they enter US once a year, not 6 month . can you please tell what kind travel document they need , is it same reentry permit ? is it I131 ? they have round airline tickets only for 2 weeks . they came on last friday . can they go to local office and get that travel document/reentry permit ? applying for document it will take 3,5 month for processing time but they need to leave for study abroad . Thank you for help !

They need to carry with them proof that they are only studying abroad, but are maintaining ties to the US by filing US income tax returns, having a perment US residence, not obtaining cheaper tuition by claiming a benefit of someone from that country. It is the same as showing you are still a CA resident even though you are going to school in MA, except that you have to show the CBP inspector the documents and they must be to his/her satisfaction. It sounds like the CBP is on to their short stays in the US so they need to be careful or they will be denied re-entry due to abandonment of their GC. The re-entry permit, I-131, has to be filed for and obtained before they leave the US, so it sounds like that is not the way to go. Many students study overseas when they are LPR, they just show their ties to the US. Now if their ties are weak that may become a problem and they risk loosing their GC.
