Does the sponsor for AOS have to be 18 when filing?

It turns out the definition of a minor varies by state just like age of consent and age of marriage, and emancipation of a minor gives the minor majority status.

Furthermore, some contracts entered into by minors are enforceable on the minor under certain circumstances...one of which happens to be when the contract is with the government.

He doesn't have to file for AOS within his 90 days. He only has to marry in that time, so there's no problem waiting until your birthday to sign the Affidavit of Support. Also, If your service center is VSC, he'll be lucky to have a visa by the end of September.

I've read that once the 90 days passes he has to marry AND file for AOS because after 90 days of being in the country his status turns into illegal alien, does anyone know if this is true? I've read all over it is best o file for AOS as soon as you can after marrying.

A minor can sign a contract, but cannot be held financially responsible for a breach of contract. Similar to student loans, you need a guarantor, which is someone who will be financially responsible for you should you breach contract. For this process...it's called a cosponsor.

My mom will be my cosponsor who makes enough to support her own family, and my fiance and I. That shouldn't be an issue according to what I've read.

Sorry, I worded my last post wrong, you are right, I meant out of status. Now I've also read that my fiance can submit another form while filing for AOS that allows him to look for a job while he AOS is processing, can this be sent any earlier than the AOS?

It CAN, but it is a pointless waste of money. You have to pay $380 to file for it and will expire when his I-94 does. It takes 2-3 months to receive the EAD, so he would not have enough time to work before it would expire. Don't bother with that. File for it with the I-485 when the EAD and AP form fees are waived.

You do not have to file for AOS within the 90 days, you only have to file within the 90 days to be eligible to file for AOS. There is no deadline to file. Many people file weeks or months, and some even years after their I-94 expires without problems. It is best to file as soon as possible, and in your case, I suggest you wait until you turn 18 and then file. It doesn't seem like you will have long to wait, if at all. You still need to get the petition approved and him go through the interview process. That takes quite a few months and you just filed last month. If you change your timeline to enter the correct service center your petition is being processed at, either CSC or VSC, your timeline will be able to reflect an estimate of when your petition may be approved.

On my timeline it says to put the lockbox location, which I have, is this wrong?

Yes it says it has been routed to California. I've updated my timeline and it now says my i129f may be adjudicated between June 4th and July 12th.

Then you add on about 3 months for the London part of the process after NOA2. Your NOA2 estimate will change and fine tune as people update or add timelines. It's only a prediction based on VJ timelines.
