Hello every one I'm new here but I just want to ask some opinion s

I'm married to American and I'm currently in the us together with my filipino son during our 9th month of marriage he is very mean and he is always chatting with girl on line and I was domesticly abuse after hitting me many time I decided to leave the house and now I'm staying with a friend with no money and no job .and I file for a restraining order now he filled a divorce I'm currently on my 2 year resident card. Would I be sent back home after the divorce and would I get something from him after what he did to us and was he still responsibly for us until I find a job ? Please help out as I don't have attorney or anyone to tell to

Hi sis! Sorry to hear your story...but don't lose heart 'coz you can still have your citizenship as per the US Law because of the abuse he did to you. DO you still remember the pamphlet given to you at teh USEM interview? There shud be some info there on what to do at times like this. Ask your friends for info on how to get help. There must be some FIL-AM group in your area and they can help you with this case. The best thing you can do now is go to a doctor and have urself checked to show some evidence of the abuse/harm done by him and obtain a copy of medical certificate indicating the dates.

Go ahead and get a divorce. You won't be sent home. A divorce won't stop you from getting your permanent green card.

You can remove the conditions on your green card even if you are divorced. To do so, you have to prove you entered the marriage in good faith. Start gathering your documents now. You need to gather documents which show that you had a relationship together with him...bank account, bills in both of your names, lease agreement in both of your names, health insurance card, etc. Also, get a copy of all your papers from your K-1 case and your adjustment of status case too.

I hope you can find a way to get a divorce lawyer. A women's shelter or Catholic Charities might be able to hook you up with a lawyer where it will cost you little or nothing. Maybe a lawyer can get the court to order some type of support from your husband for you and your son. The lawyer might also be able to help you get your papers without facing any danger from your husband.

You can file form I-751 based in bonafide marriage or in abuse, but in both cases you have to prove a bonafide marriage.You don't have to leave, you have the chance to file for ROC without him. Find a shelter for victims of domestic violence and stay there for a while.I sent you a pm message.Good luck.
