got married while on F1, left and came back, applying after re-entry

My wife is on an F1 student visa and has been in the US for over two years. We decided to get married in Oct and did so in Nov. We both we went to her home country for a month to visit her family over Christmas, and this trip was planned before we had gotten married. We decided we would file for AOS once we got back.

I now see that she may have entered the country on a non-immigrant visa with intent to immigrate. How serious is this? She definitely intends to stay in school and get her degree. When coming back from our trip we went through customs in different cities, and she wasn't asked anything about marriage at POE.

I understand that we are in a tricky situation legally, but I'm mainly asking in PRACTICAL terms of the AOS process, how will this affect us? Is this something likely to come up and/or otherwise cause us trouble, in light of an otherwise bona fide marriage, a student visa 3 years in, and a trip that had already been pre-planned before getting married?

Any advice appreciated.

As long as your wife did not lie about anything, then the issue you mention is unlikely to come up.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I agree with Ryan H. And for future reference, make sure she doesn't travel outside of the US until you have filed for AOS and received the AP travel document, as she clearly now has demonstrated intent to immigrate.

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received
