Apply for 10 years GC from 2 years conditional GC

Hi everyone,

I have a little concern now, hopefully, anyone who has solid knowledge or same experience can give me some sound advises.

I am the K1 fiance who is going to apply for my 10 years GC by March 1. As you can see on my timeline, I entered US on Dec 2010, and registered our marriage on Jan 2011. I was unemployed ever since till April 2012. My husband has been supporting me on everything financially and emotionally.

We have been together since 2005.

Now I have started to gather all the evident documents I could get.

The problem is there are certain documents we do not have at this point:

1. We do not have a joint account, for some reason, he doesn't like the idea to have a joint account, he's saying that we don't have money to safe and he's paying for everything, I don't have income, I have been shopping for myself with all his credit cards, and he never complains paying for me for everything, always asks me if I need money for whatever. He said what's the point to have a joint account. I told him that we need a joint account as one of the evident document to show the immigration that we're legit and it's for real. He disagreed with me and said that's ridiculousness requirement to judge if it's a real marriage or not. Finally, I convinced him to open a joint account, and it has been delayed, there is always something comes up. So, at the end of the Jan, we still have not opened a joint account yet.

2. My name is not on any utility bills, not on phone bill, not on TV/Internet bill, he did not put my name in his family health insurance plan. His insurance is under his parent's family plan. Since his father is a doctor, I do not pay anything to his father when I need to see a doctor, his Dad covers everything for me. Whenever I need to see other doctors, we will pay cash, he pays before I got this job, and now I pay the doctor bill whenever I have to. He said it's is a waste to add me into his parents' family health plan.

3. We do not have life insurance, we do not have kids, in our opinion, life insurance is needed when you have children.

4. We do not have children. We do not want to have children just to prove that we are legit to immigration, that's just absurd. We're still too young and too ambitious with our career right now, do not want to have children. and we're working so hard to ensure a great future and in better financial situation for the children.

What we have are photos that we all took together with his family (parents and siblings) with my family (parents and my cousins and relatives), the trips we did together with the families.

and photos with our friends together, and our friends are willing to be the evidence (writing letters or whatever to be interviewed).

So, what else should I provide? Or Will immigration give me hard time by require more documents/evidence?

I'm sure all the "fake marriages" prepared more than the required documents because they're trying very hard to convince the immigration officers they're real.

1. the point of a joint account(s) is to show financial commingling to USCIS; it does show that he is willing to give up full control of financial assets. Even if you don't have a job and everything is paid off his salary; having a join account shows without a doubt that there is financial commingling; otherwise is just what you/he says.

2. names in utilities are not as important, healthcare responsibility is also something that USCIS want to see

3 and 4: not as important

How about a lease or home ownership in both your names?

Joint tax returns?

Remember, with USCIS is not what you say but what you can proof with independently originated documentation: back statements, health care provider, etc

Tax returns, listed as beneficiary on his employer's benefits, health insurance from his employer, and joint tax returns. If you are using his CC in HIS name, you really should have gotten a joint CC in your name on the same acount. How about car insurance? I would show that you both live at the same address. You can only send in what you have and hope the USCIS accepts it. IF you have an interview you can explain how you feel about some of these items. Has he sent your family any money for support?

Timeline

Proof of co mingling of finances as proved by joint accounts (bank and credit card)/lease/mortgage is a very important part of I751.

IMO if you do not send these in you will get an RFE asking you to provide these documents.

Timeline

1,2,3 are primary evidence of financial co-mingling.

Financial co-mingling is one of the major categories for evidence for the removal of conditions, leading to a 10 year card.

Sorry, now you must generate secondary , minor evidence since you don't have any of this primary evidence type.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

actually the remark about the "fake" marriages you speak of is quite condescending. Most married couples have joint bank accounts, health insurance, car insurance, utility bills, phone bills life insurance ect..., that's what people do when they get married, whether or not they are in the middle of immigration. You act as though people who have these and need to remove conditions only do these things for immigration purposes. Way back when you and your husband knew you would need at least a few of these things to remove conditions, you don't have one. It was a matter of a few simple phone calls to get added to utility bills. You are going to need a lot more than pictures and affidavits from friends and family to remove conditions. Now today you post a new thread about abuse and VAWA...hmmmmm

I'm sorry but your position in applying for the ROC does not appear to be good. Pictures, affidavits, cards, letters, trip records etc can all be easily faked which is why they aren't considered primary evidence. You need to tell your husband to get with it ASAP and add your name to the checking account you use as your primary account, at minimum. I assume since you are using his credit card accounts your name is on the card(s). Providing a copy of that would at least be something.

Remember it's not what you or your husband thinks is important in demonstrating co-mingling of your finances and personal situations it's what USCIS thinks! It may be too late, even if you went today and added your name to the joint accounts, to prove to USCIS that you co-mingled satisfactorily throughout the last two years. Based on what you've said I'm afraid you are looking at an RFE and probably an interview.

I and my husband have been together since 2003. We do, however, have a joint checking account since January 2011.

I think you should get a joint account now and ask your husband to write a letter explaining why you do not have one until now and pray that the USCIS will understand.

How did you file tax return for 2011 and 2012? If you filled jointly, then make sure to request tax transcripts and send them with the package.

We don't have any utility bills as it's covered by the lease. We don't have a home phone, TV and/or Internet bill either. We do, however, have cell phone bills. My name is not on the statement, but I am the authorized user. So, do you have a cell phone?

We never have health insurance as we don't think it's necessary, and it costs too much. I work in a clinic, so I and my husband can get treatment as needed.

3. We do not have life insurance, we do not have kids, in our opinion, life insurance is needed when you have children.

We do not have life insurance either.

I sent in a collage with pictures taken for Xmas 2012 with my husband's family: his parents, his sister, niece, and brother-in-law. Also collages with pictures at the beach, road trip, my husband's birthday, etc.

I am writing this to show you that everyone case is different and you are not alone. Do the best you can with what you have. You and your husband are together since 2005, so I think 8-year relationship should count for something. You may write a letter to USCIS and explain the situation. Who is going to be with someone for 8 years just to "fake" a marriage :)

You might receipt an RFE or even an interview. Be prepared and good luck!

08/2004: moved to Louisiana to continue study

06/2010: got married in NC

01/2011: interview and approved

ROC: I-751
01/14/2013: Package Sent

06/12/2013: got approved!!!

06/14/2013: card and letter arrived!!!

Exactly 5 months!!! No Interview. No RFE.

Strongest Evidence? My 8-year relationship and 3-year marriage to my husband.

If it does not show commitment, then I don't know what does...

06/27/2014: Received NOA1 (Letter dated 06/20)

07/07/2014: Walk-in Bio (Appt date 07/18)
