My K1 visa was approved last year, and I am in the process of adjusting my status. I have an eight-year old son in my previous relationship, I was not married to his biological father. My son was eligible for K2 but we were not able to get him within the year my visa was approved. I have read that my USC husband can petition him as a stepchild. Is that correct? Does anyone know how long the process usually takes and what exactly are the requirements? Thank you.

That's correct. Should take about 8-12 months.

Requirements are:

The petitioner is a USC.

He is married to the step-child's mother.

He has all proper documents to support this.

That's about it. I will be back with a link for a filing-for-step-children thread.

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

06/02/2013: POE JFK!!!!!!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I came here on a k1 visa in 2007 and my USC husband filed an I-130 petition for my 2 kids who were then in the Philippines. As long as u are not legally married to the father of ur son then there is no problem. Process will take from 6 months depending on how prepared you are with the required documents. The process and approval is quicker than i though my kids got approved after 5 months.

As long as u are not legally married to the father of ur son then there is no problem. Process will take from 6 months depending on how prepared you are with the required documents. The process and approval is quicker than i though my kids got approved after 5 months.

My husband met my kids when he went to visit me but it was not asked during the process so i guess the answer is no.

I applied for two step children, one has been approval as of 1/26/13 and is in post decision, the second child's package has not been touched since 12/18/12 and is still in initial stage. Should I be worried? Should I call about the second application? Anyone else experience this?

They usually try to keep family members together. Call them and try to get them matched up. Most likely nothing to worry about but would be nice if they could interview on the same day.

Don't worry about this. You can have the two cases processed together once the second child's petition reached NVC. Here's how you do it. Once the second child's case have been assigned a case number & IIN, then you pay the AOS fee by Logging IN in the payment portal using one of the step children's case number & IIN. For multiple cases/petitions you are only required to pay one (1) AOS fee. You click on "Related Case" and a pop up window will appear that will show the other child's case number. You send two AOS packets ( each child will need a separate AOS packet).

Thanks for your response my husband and I are so nervous, that the two girls will not get interview dates on the same day. I spoke to a guy at USCIS on Friday and he stated that he would put in a "file service request". He said this would put an inquiry into the second childs status. That said, I do not trust that at all. He says we should have a response by February 16th. I have to say I like and trust your way better.

I was so excited to see your response and I just re-read it. Are you saying that once child 1's package reaches NVC and we receive her case number we should complete two seperate AOS packages, one for each child, and pay the AOS fee. I think you are saying that we are only required to pay one fee for both children and one fee covers both children. I think I got it. I will be glad when we are off this visa journey. The service request may result in the second child's approval. In my case I filed for my parents, dad's case already arrived in NVC even before my mom's was approved in USCIS. I decided to just wait for my mom's to catch up. Now both of my petitions are being processed together. We sent the choice of agent emails the same day we got mom's case # etc and paid the aos fee. I put the aos packets in separate manila envelopes & mailed them off in one USPS envelope.
