That is up to you- of the two of you, who has more time to spend with him? Does your son know his father well or would he be like a distant family member only seen for Christmas?

Will I give my son to his father to go the states while waiting my I-130 approval? btw, my son is only 2 years old

Several questions with dependant answers:

Is your child a US citizen? Does he have the US passport and CRBA? Is he your husband (USC)'s biological son?

If so, you can give notarized permission for him to travel with your husband to the US and reside with him there.

This is a tough question to answer lacking intangible facts. I'm more leaning towards the direction of... "do you trust your spouse?"

yes I do.. i trust him with my baby.. when i worked and leave the house he takes good care of my son,, ANYMORE QUESTIONS? I NEED ADVICE NOT QUESTIONS!

I told you already, a notarized statement by you authorizing him to travel with your son and reside in America with giving the exact dates of travel.

You can use these templates and modify them:

http://travel.gc.ca/travelling/children/consent-letter

It is what I used to move my daughter to Denmark with me.

What are you asking for advice on? You need to tells us; we can't read minds.

I got a baby who needs a surgery and we need to go to states but they denied our expedite request.. we did everything already, we ask help from Congress, Senator, Ombudsman, and Infopass.. No luck at all.. I am a MARCH FILER , and I AM NOT GIVING UP!... my inspiration is my spouse who is fighting also to get me and my son in the states.

Does it have anything to do with this?
