hello everyone i have a big case to discuss with you all and i hope you all give me the right thing .

i got married to an american lady in 2006 and we had a daughter then i received my CR1 visa in 2008 , i went to united states for few months and had the premenint resident card ( 2 years ) and then i had family emergency and had to go back to my country , when i got in my country me and my wife had a fight and she filed for divorce in 2009 .. so i wanted to go back but i couldnt for some reasons , so i filed Remove Conditions On residese , and i filed in usa while i was in my country JORDAN .

after i filed this form , me and my wife get back together and we normally talk and i told her about the file i sent to USCIS , she said i dont think they will do it because we had a divorce , so i went to american embassy in my country and told them they said you need to remarry your wife , so my wife came in NOV 2011 and we got married again . so she was about to send the paperwork and as many people told us to file AGAIN for i-130 , so she was about to file the i-130 till yestarday the mail man showed and gave her a file from USCIS and it was a ( 10 Years ) green card .

this is confusing right ? :)

ok now i have 2 kids from my wife

they gave me 10 years green card .

My question :

i have been away of united states since 2008 which means 4 years .

can my wife mail the new green card to me and i can enter the united states with no problem ?

Please i need a help i havent seen my big daughter in 4 years and my new son named Jordan will be ayear soon . so i really need to know and if u have anything ask me am here .

USCIS made a mistake by sending you the ten year greencard, and it cannot be used for several reasons:

- after 4 years abroad, your permanent residency has been cancelled

- You should have informed USCIS of the divorce

- You should have informed USCIS of moving abroad.

The first advice you were given is correct, your wife needs to petition you again and you need to go through the spousal via process again.

USCIS knows about the divorce , when i filed the remove of conditions i told them we got divorce

But still it doesn't change the fact that you hasn't maintained your residence in the US.

Why would they send a ten years green card if iam not allowed to enter the united states ? why they didnt denied the application when i filed it , why they send it after 2 years and half of filing the remove of condations !!! ? i never heard this before , that someone got his green card while he was away for 4 years almost . so this is confusing

what will happen if i enter the united states with this ten years green card ?

Did you ever inform them you moved out of the country? They obviously did not know. If you try to use the card they will see you haven't traveled out of the US, you are only trying to travel in within the last four years and they will turn you right around. It will not work, your wife needs to file the I-130. I know you miss your family, but look at it as a small price to pay to ensure you remain legal.

I stayed on Jordan because i had a travel ban on me for 2 years , American Embassy in Jordan knows that and i informed them about it , and i gave them proofs about that also and i showed them my returning ticket to united states also .

and yes they knows iam away of united states because when i filed the remove of condations i sent a letter with the file to USCIS and i exaplied everything to them and i told them my wife divorced me and i want to be in the united states to raise my child . they knows everything and they sent me 8 emails to inform me we have sent you the new green card and i can post one of the emails if you want ...why would i wait another year if i can Just go ??? they knows everything , why would they send a 10 years green card if they wont let me in ???? and to the lady who said it was sent by a mistake , i dont think uscis do any mistakes .

Really?! Spend some time in the forums here and check it out. The USCIS DOES make mistakes, it is not uncommon at all. As for your other questions, it sounds like you really have your heart set on trying to use the card regardless. I just hope it does not cause you bigger issues then the wait for an I-130 would.

iam really confused ... many people are living in the united states telling me dont worry and enter the usa with no problem , and you guys telling me Dont go ... so please help :(

You can try to enter, but chances are 99.9% you will be turned back as you abandoned residency by staying abroad for 4 years.

I am not sure who issued the travel ban on you (your country or the USA), but even that was only 2 years and it's been 4 years....

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

why would uscis send me a ten green card after 3 years of applying for remove of condations when they know i divorced my wife and i didnt remarry her !!! serouisly ?! they can easly denied that and thats it . right

my country , and i showed proofs to american embassy in my country , i showed them the returning ticket and the travel ban from to since , and had it for 2 years and half maybe and then waited for this file to finish but people told me and the embassy told me remarry your wife and i did she came here in Nov 2011 and we remarried , then she left and since that time we been asking what to do , 2 months ago a friend told us to file for a new i-130 , and we got the papers ready to send , then the mail came with a new green card , maybe they give it to me coz i have 2 american kids ! maybe coz i really showed i was away of usa upon my request . there is so many reason , i have people who has green card they says maybe the OP guy will let you in , why would the immigration send you a new green card if they wanna send you back ?
