Hi guys,im so happy to hear a good news about you all here.i came to the usa since august the second.i was happy to come here but things didnt go as the way i was want.my fiance now have a boyfriend, cause it take tooooooooooo long to make me come to the usa so she couldnt be alone ,this surprise me .i felt i didnt know well that person so well.so i had to be in other state,and you know what i was calling here everyday and her answer is she thinking and before my visa expired she says come to me to get marry.

but the time and the place and my mind didnt let me do this,

guys i was looking for real life and god only know how i was want to make everybody happy in this family but as they says the winds dont come as the ships hope.........anyway im here still in the usa.with expried visa and i dont know what to do.....there is a nice woman know my story and she says to me she want to help me now ...hoping one day we be together...my question is can we get marry or i have to go back home again and reapply for k1 visa again and wait for more than 13 month and this time i dont know if i will get approved or not................any help pls

4/2004 We met online and a relationship soon developed

11/16/2004 My fiance visit me for 4 great weeks

02/23/2005 CIC started processing our K-1 Visa No news yet

05/28/2005 Contacted them by phone, they are inquiring now

06/16/2005 Now the Congressmen is on the case

06/29/2005 OH MY!!! TOUCHED.......... day 127????? 7/20/2005 NOA2 mail Approved

08/01/2005 My case into get a case number

08/08/2005 Petition on its way to CAIRO Embassy

08/15/2005 Received my packet 3 from the embassy

08/21/2005 Got my police record

08/24/2005 have my medical test in 8/27/2005

08/27/2005 medical exam .will get report next week

09/10/2005 Got my medical report in hand

09/25/2005 Sent the packet to the embassy

11/13/2005 Interview at US embassy Cairo (hard one)

11/25/2005 Embassy called me to make the finger print

11/29/2005 Sent missing papers

01/13/2006 AR done in Washington and sent to Cairo

01/30/2006 Embassy e-mail visa will issue in 10 days

03/28/2006 VISA in hand

02/08/2006 Arrive to JFK

01/11/2006 my visa expried without getting married...!!!

You do not have many options. A k-1 visa holder cannot adjust status unless they marry the original petitioner or they return home after the 90 day period. You have also complicated your situation with an overstay. If you have another option I am not aware of it and regardless you will be required to "start over". I am almost sure that if indeed you have another option you will not be allowed to remain in the US but do not quote me on this. A attorney would be a good alternative

:yes: If you look at your visa in your passport it says that you are to marry the US citizen that petitioned for you, and it lists their name, so you must marry that person in order to fulfil the visa - it is the reason you came. But, since you haven't, I would contact a lawyer with your other friend.

I don't see my name anywhere in my fiance's passport. Where is it?

I just looked at my husbands passport and my name is NOWHERE AT ALL IN IT. I'm sure all the numbers on the visa are linked back to your past fiance though.

i dont think marrying someone other than the original petitioner is actually fraud being that m_hafiz seemed to enter the US intending to marry the petitioner. I believe it's fraud if he was petitioned by one chica with no

intention to marry her. Difference is he will have to go home and pursue the K3/CR1 if he chooses this path and possibly be subject to a ban for overstaying.

OK, curiosity just killed me. I looked at Khallids and I looked and looked and my name isn't on his. :unsure:

i guess its an inconsistant entry on the visas.

Might not be fraud, but adjustment of status would be denied since the K1 is issued so that you can marry the petitioner. If you marry someone else, or want to marry someone else, you need to leave the US and start a new visa petition. No need to consult an attorney, IMO, since the rules are very clear cut.

LOL....I'm sitting here laughing at myself now. I have been studying this darned visa for an hour now. My name isn't there.. Only thing on the bottom right is "clearance received, blah, blah, blah. Oh well. :star:

Its not on my husbands K1 visa either. I think it varies.

My fiance's name is not there either.

When I said fraud was in the sense that if he marries someone else and go for AOS right now, he'll be denied and suspicious might arise to the fact he entered to marry someone and married someone else. It smells like visa fraud, as if he didn't care who'd he marry, as long as he married an american for the purpose of getting a GC.
