Mistake that slipped past the NVC...

Recommended Posts

Show emails that you sent to the birth certificate place in his country and they are not responding. Show that you have contacted another Syrian Embassy in another country and you were told the birth certificate is unavaible or they cannot obtain it.

Dont give up

I dont know what to tell you but i personally would only provide info if asked

Day (33) 2013-02-08 Received Biometric letter for Feb. 25, 2013

Day (39) 2013-02-16 Early biometric completed

Day (59) 2013-03-06 Interview scheduled for April 10,2013

Day (61) 2013-03-08 received update: EAD card production

^ No no no. Thats not applicable for her situation. If you read the guidelines for submissions of documents found here - http://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-2061/0-0-0-2073.html , you can see the rules for primary documents and how they will accept secondary evidence if primary is not available. Its where I quoted the rules in my previous post.

You'll see its going to play out like this-

(at some point the issue about the BC may come up. Im torn about it. While I agree with the posters who suggest telling them first rather then letting them suspect she attempted to 'pull one over on them'. Thats material misrepresentation. Especially since she believes the person at the embassy will be fluent in both languages and will see they dont match up. They will be able to compare the translation to the BC and see they dont match. If I was her I would come prepared and when presented with it casually be like, 'yes, I was waiting for that to come up. Here is the situation-" and proceed with my case. I would not blaze into the interview with the first words out of my mouth being 'we have a problem'. If the person sees the problem it will go like the following

them- we have a problem, your BC doesnt match you need to have it corrected before we can issue the visa, according to our policies, you should be able to obtain this no problem, come back when you have it.

Her- we are unable to obtain that document as my husband would have to go to a court in Syria to have that correction made- heres proof of what he has to do (something showing he has to go to court in person) because of the conflict there and his families vocal opposition, his physical presence in Syria would would place him in imminent danger. My husband will testify to the fact, we have a sworn statement by xyz attesting to the same and documents showing his families political connections.

Them-(hopefully) Hmm yes, well based on that, you have met the burden of proof to NOT have to provide the primary document. You have demonstrated that you made a good faith effort to secure the document. You submitted enough proof to show while Syria is on the list of places where documents are available, to you personally, they are not. You gave me physical evidence that I can put in my little file to justify why I ruled this way. Thank you so much. Now I wont get in trouble when my boss reviews this and says why on earth did you let that guy through, every one knows you can get a BC from Syria.
