My wifes niece who is 37 would like to come visit us in December with her 2 year old and maybe her 17 year old son. She works for the state government in Rio De Janeiro. She has been in the US before several times. In fact she went to school here in the 93-94 school year as a sort of unofficial exchange student. Her tourist visa was extended so she never was in overstay. The other two visits were a number of years later.

Her passports and visas are all expired. While there at xmas I told her I would give her two FF tickets but she had to get new documentation.

Question I have is does the father of the two year old and the 17 year old(different guys) have to consent for the kids to get tourist visas from the US Consulate. i know they need notarized letters from the fathers to get on the plane but I dont know about the visas. She is separated from the father of the 2 year old(looks like a nasty divorce is imminent) so i dont know if he will sign anything fearing that she wont come back, although she would as no way she can support herself here.

They dont need consent to get visa but u are right that they need to have a notarized letters from the fathers when the time they are going to leave the country. But on the safe side probably it was best to have the notarized letters from the father been made already before going to the interview, they might going to ask for it.
