I just called around to find a doctor that is able to do a exam and tests etc for the i-693.

She said I need the following:

Translated AND notarized vaccine records

VALID passport or Drivers license.

However the only ID I have is an expired passport.

Ugh, now what do I do ?

I can't. Unless I am in my home country or unless I have a valid I-94 or visa/greencard, which I don't.

I overstayed my VWP by 4 years and am now getting ready to file for AOS through spouse.

Then you are screwed.

The instructions for the I-693 state that your ID must be valid (i.e. not expired).

Call up your country's embassy in the US and ask what the process is for renewing your passport. It can be done from within the US.

You don't need an unexpired document. That's just the CS's requirements. It doesn't matter any more anyway, but I would have explained I didn't have and couldn't get a non-expired ID, and if they didn't accept it, i would have called another CS. Some people cannot renew their passports in the US and they can do AOS.

I know this issue is resolved already, but are you saying you can do AOS with an expired passport? My husband's passport is expired & they only way to renew it is drive to his Consul (6+ hours away) on 2 separate occasions 2 months apart. We have spent time & $ doing this because an immigration lawyer told us he needed an unexpired passport for the interview. I hate to think we wasted the time & $ unnecessarily.

Jan 4: receipt notices

Jan 7: Checks cashed

Feb 4: 1st biometrics appointment- attempted 2 unsuccessful early walk-ins. 2nd time told that hubby needed an unexpired passport. Rescheduled biometrics

Mar 14: biometrics completed. EAD card production ordered same day

Mar 19: ready for interview scheduling

Well, I485 instruction never asks for a copy of passport - only a copy of the visa in the passport. Bring it to the interview regardless. You need to bring it because of the visa in it and the i94.

He has his visa in the expired passport (visa is expired too). He didn't have the I-94 so we filed for a replacement one. We are definitely bringing the old one but were told by the lawyer he needed to take a current one to the interview as well. I guess he would've needed a current passport eventually anyway but he could've flown to the consul in the US & got his new passport with less hassle if we waited until after he was able to get a license (after EAD), but we wanted to make sure we had it in time for the interview. :/

Yes, you can do AOS with an expired passport. Like I said, some people are unable by the laws of their country to renew their passports abroad if they cannot show they are in that country legally. So, a visa overstay with an expired passport from one of those countries can still file for AOS.

Apparently not in New Orleans. We went today to attempt an early walk-in for my husband's biometrics. First they told us that they will not take walk-ins, appointment only. Then we asked if his ID would be ok. They said that an expired passport is unacceptable. So now we have to reschedule the biometrics & wait for his passport to become available before he will be allowed to do his biometrics.

Try a different ASC?

I didn't know you could choose your ASC. We would have to go to another state.
