They will send the application back and if lucky the check/money order. I know this couple that did the samething (twice) and got the application back with the check...But really why not read the instruction is it that hard to make sure to cover your #### when sending important documents to immigration (i guess not). I have read the I-130 application and the instruction multiple times to make sure I don't get an RFE or denied and even asked different couples about their case and what they sent with each application...SMH :bonk:

I personally think that if absolutely zero effort was made in the petition there should be no check sent back! If you forget something ok, that is understandable - but in a case like this I would keep the fee. Especially since it is the second time she filed and the first was the wrong form completely which means she didn't read any of that one either! :huh:

It struck me that not everyone in their 60's have it together very well. My mother would not be able to do any of this kind of paperwork. Although she can read well it does not mean that she understands what she read.

If she is anything like my mom then your friend better forget about it. Sorry to say.

I am 21 years older than my husband, age was brought up at the consulate, our CO didn't make an issue out of it, but I have heard of others who have gone through Hell when there is a big age difference, with the wife being older. Not only will the process be difficult because of the fact that the beneficiary is from a high fraud MENA country, she is literally almost old enough to be his grandmother(I'm not judging I am stating fact).

Now to your question, I have a friend who did the same thing, her husband is from Syria,they have an age difference of 16 years, she is older, she didn't send one piece of supporting evidence with the I-130, she obviously didn't read the instructions, and didn't know about visa journey. Not only was his I-130 approved with no rfe, his interview at the consulate in July of 2012(he went through Amman because the consulate in Damascus is closed because of the war) consisted of 4 or 5 questions, they only asked to see the original documents, marriage contract, PCC, birth certificate etc...(Amman does electronic processing so copies are sent to the NVC via email), he brought and they kept photocopies of the docs, they didn't ask to see one single piece of supporting evidence, not even pictures. He brought evidence with him and was prepared to show it, but they just never asked. He was approved in 10 minutes with no AP. I don't think this is the norm, but he did get approved.

I agree, I don't think it was the norm either, he got lucky! My husband and I were questioned in Algeria (same country as her husband) about our age difference and ours is 8 years. That was just one of many grillings, they were fairly tough! I doubt they will ever make it to the interview stage anyway as she has no job or income for the last few years and no cosponsor. But that's another whole topic in itself! :blink:

It will be interesting to see what the USCIS does with her packet and if she chooses to follow up in time.

Ah well... She refuses to come here, I don't know why. This place has been a life saver for me!

Considering she is 64 and he is 26.... neither has jobs and no co-sponsor she sure BETTER be cute trying to get through DZ!

If that were some other countries and he was 64 and she was 26....no problem! ;)

I hate to say it like this, but my husband is 27 and his mother is 45... is there a chance that this woman might not be together enough to be making this choice with fully informed consent? I worry about this woman and hope she really has thought critically about this.

I've read the entire thread and I'm wondering why the many mistakes on her part. I do not know them, but I agree with your prediction: this more than likely will go nowhere.

Don't ever do anything you're not willing to explain the paramedics.

Actually you put that all together very well. When I talk with her she seems to have all her wits about her, but I don't know. I know she had high hopes for a while of moving to Algeria but he refuses that idea completely. I agree with you in hoping she really is capable of making sound, wise choices. Especially now if not before.

There is an age difference of 18 yrs with my husband and myself and we are worried about that but he has asked me repeatedly if I would move there with him if we were refused. He has asked me to move there even if we are not refused. The fact her husband refused having her live there doesnt sound like he is very much in a hurry to be with his wife. Maybe she realizes this but paying the fees instead of just not filing at all was an expensive way to go. They have so much to overcome I am not a CO but if I were I would have alot of questions.

I am sure she is aware of what happens at the NVC stage as I told her. But I also told her how to do the I-130 correctly, so go figure. It's funny because she does keep saying "I don't know why they denied us the last time. What's wrong with us?"... when in fact she DOES know - it is because she filed the wrong form over a YEAR earlier. Yikes.

DZ is the country code for Algeria.. I have no idea why.

My husband tried to explain but frankly he makes no sense to me regarding this! :bonk:

Hmmmm this is my take: If she had filed the correct paperwork and done everything right, she would have stood the chance like everyone else to get an approval. Why? Because they would NOT be proving 'age difference' but rather the bonafides of the marital relationship. Granted that, in immigration, it would seem odd and smell fishy to have such a big gab in their age which would entail they(i.e. the couple) going above and beyond to prove that their marriage is genuine and not for immigration purposes only on the part of the beneficiary.

In general however, it is not too odd and unheard of to have married couples with a large age difference. For instance, a lot of celibrities and some hollywood stars come to mind. Some very wealthy and ultra rich people mostly fall in this category as well. Recently in the news in Spain I believe, there was this lady almost hundred years marrying someone 60years younger. I see a lot of couples who look 20 or 30, even 40years younger or older who seem perfectly happy together.

Coming back to the topic though, for immigration wise, proving the bonafides of the marriage to USCIS and/or a CO would be an uphill task! And it doesn't help also that she can't follow instructions and file the right forms with supporting documentation. Make you wonder...

Our love began in 2010....our Journey in 2012 (January) and now we are at peace until 2014!

Timeline (kinda-- Im not putting exact dates- just months~)

--January 2012-- Sent our I-485 and I-130 packet off :)

--February 2012-- Touch-- Need more evidence.

--February 2012-- Sent more evidence.

--March 2012-- Biometrics and Doctors App (around the same time)

--June 2012-- (BIG PROBLEM) Immigration sent us a 'DENIAL' letter due to not having a sponsor (I thought we didnt need one)

--June 2012-- we hired a lawyer and got a sponsor, got the I-290B Motion to Appeal or Reopen had everything sent off by the end of July 2012.

--October 2012-- OUR APPEAL WAS APPROVED (breath easy, we didn't have to wait too long)

--October 2012-- Work permit sent-- got SSN

--November 26th, 2012-- AOS interview-- Got sent out told to get a translator and new interview date would be sent. :(

--January 8th, 2013-- Second interview...went well but no idea if we were approved or denied....VERY STRESSFUL!!

--January 15th, 2013-- APPPPPPRRRROOOOVVVEEEED!!!!!! (checked on USCIS web site)

--January 18th, 2013-- Card Production Ordered....welcome letter (hard copy) in the mail!!! :)

--January 24th, 2013--CARD IN HAND!!! DONE!!!!!

MedRoni.....is your husbands friends even in this marriage for the right reasons? Does he even care about this woman or is she just an easy meal ticket to the US? I dont wanna sound mean but.......this situation screams fraud!!

So, I'm not the only one that thinks this..... This is a red flag on his end and a white flag on hers. That's what it seems to me. I agree with another poster: maybe she wants to be denied. At 64, I'd be discouraged to support a man that could be my grandchild, when I can barely support myself. Is there any proof she actually submitted the paperwork? Is your husband telling you what his friend says? Maybe she told him she did all these things (i.e. submit I-129F and then submit I-130 incomplete, etc.) as excuses. Who knows! Here on VJ we've seen/ read worse!
