Just so I understand when it comes to renew it my TPS in sept 2013 and if not finished with my AOS , should I then renew my current TPS ?

I do not know that much about TPS, but filing for AOS should place you in a period of authorized stay while your AOS is pending, so I am not sure you would need to renew your temporary protected status. You will not need to renew your EAD for sure, since you will be getting a new one with the I-765 you are filing with your I-485. Do you think they would give me a hard time bc I don't have my I-94 ? I have a red stamp in my passport staying where I came through into the us

I also have a question on form I-864 . My husband who is the person requisting me. We filed our income tax as joint married. When it's asking for the annual income , do I include both of our income or just his ? His income

Is over the poverty requirement for our Household

Size ? Don't know if we need to list both since we file our taxes joint married ? Please help !

Include a complete copy of your joint return with all forms, schedules and W-2s. That will show the individual income amounts for you both. If his income alone is enough, then you do not have to list yours. If you want to list yours, then simply put it on #24 b., put your combined total in #24 c., check #24 e. and enter your name there. No need for any other forms. Both of you would include proof of your current income with a letter from employer and/or recent pay stubs.

What do u suggest ? Should I list my income or just my husband ?

It is entirely up to you, but putting them both shows for sure you are well over the 125% requirement and will have your affidavit of support approved with no problem.

Ok you said to check off 24 E "the person listed above ------does not need to complete form I-864A because he/she is the intending immigrant and has no accompanying dependents , we have a 2 year old son isn't he my dependent . I'm just a lil confused where it says "and has no accompanying dependent "

You have a son together, so he is a USC correct? He did not come here on any type of visa or is also under TPS with you? That means he would not be counted as an accompanying dependent. If you have dependents accompanying you, then you would need to fill out the I-864A as the instructions state.

I'm going to list my income on the I-864, on question #25 Federal income tax return infomation. i am going to attached copies of the last 3 tax years. on the total income for each year should i combine my husband & my income ? Or just list his total income for past 3 tax years ? Since i am going to list my income on line 24B . im just a little confused now.

He is the sponsor and the one filing the I-864 for you, even though your income can be counted too. He answers all the questions with his information, except the ones that specifically ask about listing you and your income. You need to provide proof that your current income will continue from the same source after you are a permanent resident. Perhaps get a letter from your employer stating your income and that your position is permanent and your employment will continue uninterrupted after you gain permanent resident status. Page 7 of the I-864 instructions states you must provide the evidence of ongoing income from the same source.

Of course if your husband's income is enough for his household size plus you(himself, any minor children, anyone else he claims on his taxes and you) then no need to list your income at all if you do not want to. http://www.uscis.gov/files/form/i-864p.pdf
