I currently have TPS and i am now in the process of adjusting my status. my question is do i need to fill out form I-765 since i already have a work permit through my TPS. it will expire on 9/9/13 but they've been extending it for almost 13 years now. Please Help ! i will greatly appreciated it !

Unless you already have an EAD, the first one. The second is if you lost your other EAD, the last is if you're renewing it.

I would pick 1.

Yes i currently have TPS (work permit that will expire 9/9/13) THats why i was confused if i should check one number one or the third one.

Then do option 3 and include a copy of your card (front and back).

Check one. You are applying for a new EAD under a different category, (c )(9 ). There is a question about having a previous work permit. You can put all the info about your current one there.

See that's what I thought, different category, but I figure USCIS has seen this all the time so they'll know... I prefer the 1 option with C9 otherwise I'd worry they won't renew it because it' not "due" for renewal.

This is a new category, so they should be checking 'permission to accept employment' because they are applying for a new EAD under a new category through AOS-(c )(9 ). This is not a renewal. Hopefully the OP will return to see this.

Thank you guys so much for all your help ! One more question , since my TPS will expire in 9/9/2013 , if I'm still in the process of AOS. Do I still renew my TPS by then ? I am getting to send all my paperwork in about a month or

So . My only concern is the my I-94 is lost so I won't be including that with my package ? Don't know if that would cause a delay in my case ?

Jay-Kay stated you file the I-765 and tick option 1. You enter c9 as the reason for the EAD. You will get a new one with a year expiry date. You wouldn't use the old one anymore.

Just so I understand when it comes to renew it my TPS in sept 2013 and if not finished with my AOS , should I then renew my current TPS ?

No. You are filing for EAD based on i-485 (AOS). That EAD will be valid for a year and would REPLACE your TPS EAD. You wouldn't use it anymore. You will work on the AOS EAD.
