have not filed 2009, 2010 and 2011 taxes. planing on backfiling tomorrow and setting up a payment plan with IRS.

Would that affect NVC decision on my petition? :blush:

I understand it will affect off course if I do NOT file. Now, I am filing those three years, what you mean by trascripts? Tax return that I print out from the website where I file, is that enough?

Timeline

Setting up a payment plan with the IRS isn't a requirement for this stage though. Not saying you shouldn't pay your taxes just saying you don't have to feel like that is a big cloud hanging over you.

My husband did his 3 last years of taxes in one go when I was moving over. He did set up a payment plan but not until the whole visa process was over, one thing at the time, this whole process can stress you out enough!

Not as long as you file. If you don't file, then they will not proceed further with your case until you do file. Once you file, you're good to get proof that you filed and you'll be good to go on the immigration front. :)

You better be sure your tax returns match what you reported as your income on the I-864. If not, that could cause a problem on both ends!

I will copy the income figures literally from the tax return for those 3 years.

all are different states of being, depending on 'state'.

usually, when you file a return where you OWE money, well, yer supposed to include a check for the amount you owe.

You will be fine on the AOS as long as you file and pay the back taxes. You will of course have to pay a penalty. It is 5% for each month it is late or a maximum of 25%. NVC only requires tax returns for the current year (2012). If you live in a country with strict requirements, then it would be best to have returns for the last 3 years paid up front and submitted to NVC. Otherwise you can file for 2012 now and take your time on the back taxes (and new AOS) that you would bring to the interview.

I set up a payment plan. Would that affect the approval process at NVC. Also, I took my tax returns to the local IRS office and had them time-stamped because I don't think my tax transcripts will be available by the time I am required to submit AOS packet. So, I will send in with I-864:

- Lat3 years Tax return ( time stamped by IRS as received)

- W2

- All schudles

- Letter of Employments.

Would that be enough?
