Not Sure What to Do Next, Please Help :)

Hi there,

I posted awhile ago about my AOS case because it had been a long time since I heard anything. Many of you suggested I make a service request. This was my original post:

We were married March 17th, 2012. We got our NOA for our AOS April 23rd, bio appointment May 14th, our case was transferred May 24th. Haven't heard a single word since. Is this still within normal processing times, or is there something we can do to inquire about our case?

I called the National Service Center (NCSC) number 1-800-375-5283, which is the same number which is recommended on my Transfer Notice letter if I have questions about my case. I put in my info, and all they told me was to wait 180 days. It's been 245 days as of today (January 24th). The automated voice didn't tell me what to do if I was outside of normal processing times. The automated voice said that was the most update info about my case.

What do I do now? If that the wrong number to make a service request? Thanks for your time.

I had to go through a tier 2 officer to get a service request in, because I ran into a lot of road blocks everywhere else. Call the number back and ask to speak to a tier two officer. The wait times are very very long, or you can ask for a call back. The bottom line is everyone who got transfered right before the 1 August deadline may have gotten screwed over. The officer told me flat out to start getting ready to renew the EAD card, and the AoS cases can take up to 12 months now for people who got transfered for the "speedy" processing. I dont want to start rumors or anything, but that is the information given to me when I called.

Yes, you can call from 8 am until 8 pm.

There are live people there. You just have to press the right buttons on your phone (I'm not calling right now, so I don't remember which numbers you have to press, but once you listen to the automated voice, choose the "report a problem" option). From my own experience, even tier-2 officers can not give you any better information about your case than the one you get from the automated voice or the phone operators. Chances are that s/he will tell you to wait. If you or your representatives have put in a service request, and were told to allow it 45-60 days, then allow it 45-60 days. I believe your case will be processed within that period of time. Mine was. If you haven't, it's time to do it now.

I suggest you do an INFOPASS and go to your local office because AOS is now around 90 to 120 days so something is not right here.

Not sure where the 90 -120 days is coming from - it is taking most of us much longer than that. Only a lucky few september filers have had their interview and received green card - and still a lot of August filers waiting to hear something as well

245 days is for sure out of normal processing time. You need to ask to speak to a tier 2 rep.

Word-of-mouth reports are that the I-812 "deferred action" influx (for work permits for children of illegal immigrants) has overwhelmed the system. i'm still trying to get official confirmation.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Calling USCIS, I've had quite good luck pretending I really cannot find the receipt number on my notice: that is, listen to them explaining how to find it, press the button to say you still can't find it, etc. until you get through to a human. Then tell the human your receipt number and say that you want to make a service request. When I called, the tier-1 person said he couldn't make one (since there are no official processing times for CSC), but the tier-2 person was really nice and helpful. I think the waiting time to get to a tier-2 person was about an hour, though.

That said, I think you should contact all of your senator/congressman offices and ask for assistance. Where I live, they even have these USCIS-specific information release forms on their websites which make filing a request very straightforward (they probably deal with like... loads of these on a daily basis). I'm about 90% sure it was one of my senator requests that finally made them pull my file from the CSC (after about 9.5 months) and transfer it somewhere else.

I took your advice and pretended I didn't know where my receipt number was, it worked like a charm, thanks! LOL

The lady I got was very nice and helpful and was able to put in a service request for me. I should hear something bu February 13th. Here's hoping. :)

You can now make a service request online by using the e-Request feature on the USCIS website - https://egov.uscis.gov/e-Request/Intro.do. Your case must be outside the normal processing times. I made an e-request about my AOS 6.5 months after the date my case was transferred to CSC and it was accepted and a service request was put in. I got the standard response 5 days later:

"The status of this service request is:

This notice acknowledges receipt of your status inquiry concerning your pending I-485 application. We recognize your interest in a final adjudication on your pending application and are aware of the difficulties caused by any delay in processing. The California Service Center is committed to processing this workload, and will be making every effort to adjudicate your case in an expeditious fashion as soon as available under our resource constraints.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283."

Basically I just have to wait.... ho hum....
