Filed Waiver in Montreal

I honestly don't know what my waiver is for. At the time I was told it had to do with misrepresentation, then they changed it to lack of documentation pertaining to my marriage. On my visa denial it states that it is due to section 212(a)(9)(A) Expedited Removal. If anyone knows what this actually means...please let me know. Thanks!

Section 212(a)(9)(A)(i) of the Act provides that aliens who have been ordered removed from the United States through expedited removal proceedings or removal proceedings initiated on the alien’s arrival in the United States and who have actually been removed (or departed after such an order) are inadmissible for 5 years. Section 212(a)(9)(A)(ii) of the Act

provides that aliens who have been otherwise ordered removed, ordered deported under sections 242 or 217 of the Act or ordered excluded under section 236 of the Act and who have actually been removed (or departed after such an order) are inadmissible for 10 years.

Congressman and Senators can't influence how long processing takes - they can only check into status of a waiver. If the service center or consulate is backlogged, there really isn't anything they can do.

Hi,

My wife went to the interview in Montreal on October 12. Since her overstay of more than 1 year, we submitted the waiver papers. They did accept it and have already sent to Vermont. I have few questions.

1. Do the consular officer provide a recommendation on the waiver before they send it to Vermont?

2. Will I get a NOA-1 for the waiver?

3. How long is the approximate time that it will take to process?

I would apprecaite any insight that you can provide.

you will not get any kind of recommendation from the consular officer

you will get an NOA-1 for the waiver submission - this is the date that you use for the processing timeline

we waited nearly 7 months but then we contacted our Senator as well as sent personal letters to the Vermont Service Center Director

I have been told the average waiting period for Montreal out of Vermont is from 6 month to a year

02/23/05 - Met as Friends

09/29/05 - Married in Victoria BC Canada

11/04/05 - File I-130

11/18/05 - NOA1 I -130

12/08/05 - File 1-129F

12/13/05 - NOA1 I-129F

01/09/06 - APPROVAL I-129F

03/23/06 - I-130 APPROVAL

03/23/06 - K3 interview in Vancouver, Canada

03/23/06 - K3 denied due to CMIT 23 years prior

03/23/06 - i-601 Waiver Submitted

04/07/06 - NOA1 for I-601 Waiver received

10/18/06 - I-601 Approved out of Vermont

11/27/06 - 10:00 appointment at Vancouver Consulate for Visa Stamp

11/27/06 - Arrive home 8.5 hours after crossing the border in Blaine Washington, due to horrible show storm --- we were happy to be home

01/04/07 - AOS sent off

01/10/07 - NOA - 1-485

01/25/07 - RFE for I-824 - used and outdated form

02/14/07 - Get email stating Post Office has Address posted as Vacant from the USCIS

02/16/07 - Hubby gets WA State Drivers Licence

03/05/07 - AOS appointment April 19, 2007 Seattle

04/13/07 - Biometrics Taken for AOS

04/19/07 - AOS interview - Approved pending name check

04/23 - 05/28 - 5 additional appointments with the Seattle USCIS office - to clear up the EAD issue

05/15/07 - 90 Day EAD Arrives

06/10/07 - EAD/Green Card approval letter arrives

06/15/07 - EAD arrives

06/23/07 - 2 year conditional Green Card Arrives

My husband called Vermont yesterday and so far we're getting the standard reply- PROCESSING/Pending. Joanna

Married August 21 2004 in Nova Scotia!

October 19/04 sent I-130.

April 17/08 finally arrive back in New Orleans after 3 years and 8 months.

May 19/08 Perm Resident Card arrives.

July 24/08 Reapply for a new SS card with married name.

August 4/08 Baby daughter born.

I see that HMG got their waiver approved. Maybe there's hope for us yet. I'm not sure about their time line though. So maybe there's approvals coming for us soon.

I see that HMG got their waiver approved. Maybe there's hope for us yet. I'm not sure about their time line though. So maybe there's approvals coming for us soon.

Looks like theirs was Nov/06. Not sure how there's would be approved before one sent in March/06, received April/06. But I guess there really is no rhyme or reason with USCIS.
