I-130 bring in sister

Timeline

Last year Feb., 2012 my husband filed I-130 for his sister, but so far we just received I-797C, notice of action, $420 been cashed. Saying the petition is in process. When I check it online today it saying:

"Initial Review

On February 8, 2012, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators...."

I want to know how long it takes to the next step of request for evidence? anyone knows it?

If your husband sent in translated copies of birth certificates and the siblings have same mother listed, they may not ask for any further evidence.

From what I read, it takes a couple of years to get approval on a FB-4 category I-130...

Petition for siblings (F4 category) in China will take 12 YEARS to complete (from i-130 filing to visa issuance). http://travel.state.gov/visa/bulletin/bulletin_5856.html

For California Service Center they are currently processing i-130 (US citizen filing for brother/sister) filed on FEB 11, 2010.

For Vermont Service Center its NOV 20, 2010.

For Texas Service Center its JUN 1, 2012.

usually, when the I-130 is approved, it's sent to national records center for storage. When the priority date is current, it's sent on to NVC for further processing.

however, why not call into USCIS and inquire about the casefile status?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I filed for my sister in August 2010. Last year, right about 2-yr mark I received approval notice - hard copy - never really bothered with online tracking given how long it will take. What I did is when we moved, I sent I-865 for a change of address and a copy of NOA1 to CSC (this even though they don't have a I-864 on file from me yet but the case is still processing through the system).

I don't think it will be reveiwed again till the date gets current, seems like you submitted it OK.

so it took you only 2 years to get a green card for your sister? I just applied for my brother in law so I am hoping for a quick approval too.

My Timeline:

2/27/2007 sent I-129f

5/??/2007 USCIS needed additional info

7/23/2007 I-129f approved

8/3/2007 NVC approves application

8/27/2007 NVC sends approval notice to Seoul embassy

9/6/2007 Seoul embassy finally receives application/filed for interview

9/21/2007 worried about interview

10/13/2007 K-1 approved.

10/20/2007 Arrived in Ameriva

10/29/2007 Filed for marriage certificate

11/24/2007 Filed for AOS I-485 and AP

12/18/2007 Received RFE (overpaid, had to resend check)

1/24/2008 USCIS resumed application process/biometrics appt received

2/04/2008 Biometrics appt

4/??/2008 AP approved and received

9/??/2008 AOS interview schedule received

10/22/2008 AOS interview

11/3/2008 RFE received and returned

FAST FORWARD to Dec 2012. US CITIZEN!!

No, it took 2 years for USCIS to approve the i-130, NOT the green card.

Petitioning a sibling takes a long time. Since you're from South Korea, it will take 12 YEARS before your sibling can immigrate.
