I am currectly in process of finalizing my divorce in DR & I am planning on marrying my bf who resides in DR! I am going to file K1 petition due to the 10 month restriction they have in DR for woman to remarry. I was just wondering since I'm new to the site will that effect my approval?? Also my ex husband was from DR and I had petioned for him in the past but things didnt work out 8 years later. Me and my ex did a k3 visa and divorce should be over and done with in febuary. My boyfriend and I do want to be united and understand there is a wait and patience will be the key. Especially now I just had twins from my boyfriend I think now is the time to start mapping out a plan for our future.. Any suggesdtions would be greatly appreciate

First welcome to the site you came to the right place!

I'm not sure if you are aware but K1 is a fiance visa, therefore you can't plan to be married. Now if you are planning on getting married to your now boyfriend you need to look into CR1 (marriage visa), Their is no long the K3 (CR1/IR1) route. As for you filing another petition for someone else this will NOT be a problem but do expect to get questioned the day of the interview as if you had ever filed for someone in the past.

My only suggestions will be read, do your homework on this site, asks lots of questions. This is a very helpful site you will find most if not all of your answers to your question on here, make sure you have all the supporting documents you will need to file the paper works accordingly and promptly. I must have misread the original post, but no where did I read that the OP was planning to get married in the DR...just that she was planning to get married. One of the main requirements of the K-1 fiance visa is being legally able and willing to marry within 90 days of arrival to the US. In other words, planning to get married (in the US of course) meets one of the basic requirements.

In short: If you plan to marry in the DR, you will need to file an I-130 petition (for a CR-1 spousal visa). If you plan to marry in the US, you will need to file an I-129f petition (for a K-1 fiance visa).

If I understand you well, you are finalizing divorce now. You need to wait 10 months to be able to remarry and you don't want to waste this time. So you plan to fill K1 and get married in the US in 10 months (or +... when the K1 is granted).

If so, K1 is the right choice. I think you actually have to be divorced to fill the I-129F petition, you can't fill it before it is finalized.

Welcome to VJ, yes the K1 is the best way for you to go. Just an FYI since you are not divorced yet and have had children by another man in the US the husband is automatically assumed to be the father even if he is not, so if you have not done so already make sure you get the boyfriend/father added to the BC. Otherwise that and the fact that you have done a petition before through the same Embassy the questioning this time maybe a little tougher. But other than that you have been through the process before and looks like you are on the right track now. Best of luck to you on your journey.
