I-130 while in the US

I just realized I made a mistake. I send the I-130 package only but I am not outside the US. My husband is American and it is filling for me. I'm current under a F-1 visa. What should I do know? Re-send the package or just send the additional forms to the same address?

i don't think your package will meet up to your file, it's best to wait see if you get a rfe or your file returned,did you get the receipt yet noa-1 what kind of mistake,in my opion just wait an see what they do.about it.

What is a RFE?

I just sent my package TODAY so I will try tomorrow to intercept the package before it gets to the USCIS.

If I can't intercept the package I will start working on the others forms and mail them to the same address.

What is a RFE?

I just sent my package TODAY so I will try tomorrow to intercept the package before it gets to the USCIS.

If I can't intercept the package I will start working on the others forms and mail them to the same address.

if its fedex or ups you can do a return before delivery as long as it isn scheduled to delver tomorrow

Don't panic. You can still file the AOS paperwork. Someone with more knowledge about this needs to help, but from what I understand, in about a week or so, you will get your NOA1 from the I-130 petition that will have a receipt number on it. You will need that number to match that packet with the I-130.

What address did you send the I-130 to? If you sent it to the address the is supposed to be for an I-130 and I-485 filed concurrently, it's possible they will just send it back. If you don't wait for either NOA1 or the I-130 to be sent back, you could have problems later.

I sent through USPS. There is a possibility of package interception for USPS too. I just print the form and I'm going tomorrow morning to the post office. Hopefully it will work.

This whole immigration is so complicated and expensive. Honestly, I hate all of this.

What NOA1 stands for? Sorry, I don't understand more than a half of the abbreviations used here.

Do you think I should try to intercept or just let the package be delivered and see what they answer?

If you can intercept it, that's better. Then you can file everything together.

NOA1 stands for Notice of Action. The first one you get merely lets you know that they have received your packet, and gives you something to track it with and worry about for the longs months this process will take. Also, your NOA1 for adjustment of status will be your proof of status if your visa or I-94 expires while you are still waiting for adjudication.

I will definitely try to intercept the package but if I can't at least I know everything isn't lost. Also from what I have read here just now, it seems like the timeline for the I-130 it is longer than if you send the I-130 with the AOS forms.

I'm under a student visa now and one of the reasons I made this mistake it was because I was freaking out of being out of status and rushing to send something soon. My college staff is blackmailing me because I decided not to take classes this semester and I was very worried about it.

Hi JKelly, I read in another thread that someone did the same mistake I did and later sent the other forms. That is what I've decided to do because intercept the package I already sent it would be a hassle and it is going to take a while for me to gather the other forms and docs together so I wikk just wait for my first NOA and then mail the rest to match with the first package and hope for the best.

No worries, it shouldn't even delay your case, really. When you file the I-485 package, make sure you include a copy of the letter you receive saying they received the I-130. They will match them up. Good luck on a speedy process!

We filed the I-130 and the I-485 separately inside the USA. You just need attach the I-797 Notice of Action to the I-485 that you send in. You say you sent it to Chicago address though? I'm not sure what state you are in, but I think ours was sent to California (for the I-485). I think Chicago is for concurrent filing of both the I-130 and I-485.
