Coming back to this topic:

It seems on turbotax/handrblock online there is an option to declare worldwide income and to apply for the foreign income exclusion. I'm looking at filling these out and printing the return to mail, then including the signed statement to treat my spouse as a resident for the tax year. Seems like this might be the easiest way to go... I'll update as to how this works out.

Would you by any chance have a Sample of that Declaration? I dont know where to begin on writing it. I already googled it and no samples available...

Would you by any chance have a Sample of that Declaration? I dont know where to begin on writing it. I already googled it and no samples available...

I ended up going into an H+R Block office that had dealt with non residents before. The particular office had their own declaration that we both signed. It was unofficial but they had come up with it since this situation had cropped up a number of times. Basically stating to whom it concerned that we would like to be treated as residents for the tax year, signed by us both. When I get home I will check to see if they gave us a copy of that and I'll try to get it to you!
