I'm adjusting my status from B2 and I received RFE after AOS interview from my local USCIS office asking my wife (USC) to file her taxes jointly.

Am i considered as a resident or non-resident ?

Under filing status in 1040 form , What box she should check ?

8/16/2012 (Day 1) sent AOS (I-130/I-485/I-765)

8/20/2012 (Day 4) Package Received

8/22/2012 (Day 6) Text/email notifications (all 3)

8/23/2012 (Day 7) Checks checked

8/27/2012 (Day 11) Biometrics letter received, appointment on 9/6

8/28/2012 (Day 12) Received all 3 NOA1 hard copies

9/5/2012 (Day 21) Early walk-in Bio metrics successful (1 Day early)

9/27/2012 (Day 43) Received text regarding Interview ( October, 29 )

9/29/2012 (Day 45) Received interview notice hard copy in the mail

10/24/2012(Day 70) Received text regarding EAD card.

10/29/2012(Day 74) AOS Interview .Still waiting for Decision.

11/1/2012 (Day 77) EAD in Mail.

1/10/2013 (Day 147) Received Text for RFE

You the spouse can be considered a resident for tax purposes, even though you are not a Legal Permanent Resident yet.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

@'David_40' - Could you pls elaborate more on this? What happened at interview, Your wife earnings are above poverty guidelines or not? She is the only sponsor?

Day4 -- 09/26/2012 - Emails/texts acceptance confirmation in evening :-)

Day5 -- 09/27/2012 - Checks Cached

Day12-- 10/01/2012 - Received hard copies of NOAs for I-130, I-485 and I-765

Day16-- 10/12/2012 - Received Biometrics Appointment(appointment for 10/24/2012)

Day16 - 10/12/2012 - Biometrics Walk In - Refused

Day20 - 10/16/2012 - Biometrics Walk In - Successful :)

Day33 - 10/29/2012 - EAD card Production Ordered-Pleasant surprise :)

Day37 - 11/02/2012 - EAD Card received - WoW !

Day40 - 11/05/2012 - Interview letter for Dec 4 date - The BIG Day !

Day70 - 12/04/2012 - Interview done. Pray to GOD!

Day95 - 12/28/2012 - Letter for 2nd Interview in Feb

Its not required for AOS. Its required to proof our relationship.

Its nice to have but not mandatory. This is another strong proof.
