I got an email from my Senator today, USCIS changed my husband's address to AMERICA! They think we are both there! #######!

Why me?

OMG! NVC did the same thing to us this month! They changed my husband's address to the US without our permission and tried to convince us that they would never make that mistake and that we must have requested his address to be changed. I understand your frustrations! The NVC CSRs told me that they can't change a beneficiary's address over the phone and that we had to send a formal letter requesting his address to be changed. I also talked to a supervisor and she helped us with information but we are still waiting to see if they have fixed this mistake. So my thoughts for you is to get that formal letter mailed out, and make sure to write that you never requested the address change and that you did not write a US address for your husband on any forms, just in case any one tries to blame you both for doing in on purpose. Talk to someone higher up on the phone and your senator as well. If I were you I would send out an email from yours and his email that says the same as the mailed letter. Keep calling until it gets fixed and eventually you will get help. I'm sorry this happened to you too! Very annoying and frustrating!

USCIS I-130 Petition for Spouse

September 2012: Filed from abroad to Chicago Lockbox

4 days later: NOA1, Routed to California Service Center

7 days later: Transferred because of new jurisdiction

5 days later: Case Status changed to: Under processing at USCIS office

NOA2 arrived 78 days after NOA1 :)

*I-130 Approval Notice hardcopy finally received in Pakistan, the only notice that arrived.

This is terrible, Nola. So sorry to hear about this latest dramatic (and idiotic) turn. Definitely request an expedite. And don't worry about rude people on this forum they don't know anything about what you've been going through. I know if I were in your shoes I'd be freaking out way worse.

It's frustrating to see an address mistake, but I don't see how you would qualify for an expedite when you have only received your NOA1 in November. Did I miss something in other threads that would make them need to push you through faster than normal?

Ahh this makes me kind of worried. I randomly got an update on my case saying that my address has been changed, I didnt do that. I called and they said they dont see anything wrong with it but I have hard times trusting them. I had another thing going on with my case and I called THREE seperate times and was told something different EVERY single time. It was frustrating :o I still dont have a straight answer on that..

You must be so annoyed,, I hope u get an expedite out of this too :)

But I have a question..How do you get in touch with your senator? Did you just email and then they responded?

Just curious sorry if Im missing something :)

Yep, it is ok. I did file for an expedite on medical grounds and I didn't feel bad doing it with so many November filers already approved (which we probably would have been to if it hadn't been for this error).

I know some people have been having their addresses randomly updated, so I don't think it is something big to worry about. We did get two address change notifications in the mail, but there was no indication that they changed the beneficiary's address.

Calling for the most part seems to be a waste of time and actually messed up our case, I suppose I should have just had more patience but I was worried that we would not receive any RFEs if we also didn't get the NOA1.

To get in contact with our senator, we filled out an online form on his website many have a "How can I help you?" section. Then we submitted it, printed it off, signed it and e-faxed it. It was a pretty painless process.

Oh I know...me too!

Anyways, I can also feel Nola's frustrations too if that happened to me. Having just anything additional (even perceived) to slow down the process will get me peeved. :angry:

i dont know if you read her original frustrations not getting noa1 and having to change her address for no good reason because she wasnt getting their mail.

soooo yes. lots of warranted frustrations up in hurr.

Actually there was no crying over this. I did yell a bit when I got the email at about 11 pm our time, which woke up my poor husband who has to wake up at 5 am. I'm actually really relieved that the mistake was caught. I am getting pissed off about the know nothing CSRs though - no foreign addresses, drive to the embassy for more information? There is just too much fail.

Please ask for an expedite based on USCIS error.

This will NOT slow down the petition and it is appropriate and you will already be talking to someone to make it happen.

The thing is that it makes no sense that we'd change his address to America in the middle of the I-130. What kind of beneficiary moves before they have their visa and doing so and then telling USCIS would be basically likes saying that we fraudulently used VWP. I mean, the whole thing doesn't add up. *sigh*

I'll get on the letter writing, but mail seems to take a strange and variable time from Denmark to US and the other way around (I got two letters last week on the same day, one was mailed Mid-November and the other 3 days before from the same town in America). :lol:

I assume we'd write the letter to NBC? Or should I just CC Hartford as well? I'd wait to talk to the ISO to write them, but our mail pick up here is probably before I'm going to be able to reach one.

Here was the email I got yesterday:

Thank you for contacting Senator Blumenthal regarding the immigrant visa application you submitted for your husband. Senator Blumenthal asked me to email you because I assist him with immigration matters.

I checked on the immigrant visa application you submitted for your husband and was told the address was changed on December 12, 2012 to reflect your husband having a CT address in Madison. Please let me know if this is correct because if he is abroad and his I-130 gets approved with a CT address, then you’d have to file another application to get the file relocated to the Embassy. If he is in the U.S. please let me know ASAP. Also, if he is in the U.S., please let me know how he entered just to make sure he would be eligible to adjust his status, ie. If he entered under the visa waiver program, he cannot adjust his status.

Wow. I wonder if you can get an expedite on your request now that they've screwed up.

I see USCIS error as a valid reason to expedite. And this seems to be a significant error.

USCIS can not expect you to 'eat' their mistake. Their error has inconvenienced you and that should be grounds to expedite case.
