Standalone I-130s transferred to field office

Folks, I just talked to a Tier 2 ISO rep at the USCIS about my pending standalone I-130 filed in the US.

As of August 15, standalone I-130s have been systematically transferred from service centers to field offices for adjudication as part of a workload transfer, per the USCIS website. This is the link to the pertinent page: http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c3c7ca7c5fed9310VgnVCM100000082ca60aRCRD&vgnextchannel=e7801c2c9be44210VgnVCM100000082ca60aRCRD The pertinent wording from that page is, "Stand-Alone Immediate Relative I-130s will be transferred from the Service Center to the National Benefits Center (NBC), and then routed to the appropriate Field Office."

My standalone I-130 was filed in October and transferred to a field office in November. I called to try to find out the status of my case, since it had been more than two months from the date the case was transferred. The ISO insisted that cases are normally transferred to field offices if they intend to call the petitioner in for an interview. I told him about the workload transfer page, and he still insisted I should expect to be interviewed. I asked him, just to be sure, if he saw any specific information in my file that led him to believe that I was going to be called in, and he said no, that cases were just usually transferred to field offices for interviews. :unsure:

As far as I know, many members of this forum have had their standalone I-130 cases adjudicated and approved by field offices without any need for an interview. Is that correct? Do I need to prepare for an interview at my field office? :(

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

Well I received an RFE from my local office back in DEC which we never receieved any updates saying our case was being transfer to a local office just when we got our noa1 they said our case was transfer to NBC. We submitted everything they asked for the end of Dec. Hoping for an answer soon! and I'm HOPING that they gave you the wrong information. We filed our 1-130 back in August.

I think there have been only 3 members of VJ who have been requested interviews due to this Field Office switch.

We received a NOID which we responded to mid Nov (because they wanted beneficiary BC). When hubby called USCIS hotline last the CS rep tried to put in a service request because the FO was behind in responding to the NOID only to be told the system wouldn’t allow it because we were still within Vermont’s very delayed processing times and would have to wait another 3 months to put in a request.

There have been a few more RFEs for beneficiary’s BC.

Lots of approvals without them - as they’re not supposed to be required at this stage.

Anyways, what I was trying to get at is all bets are off at this stage because some FO are not working from the same page as the Svc Centres.

Speedwell- Our interviews will happen in London though ad not US right?

The VISA interviews will happen in London AFTER the I-130 is approved and you have filed the rest of the visa paperwork.

It turns out that my I-130 was in fact sent to the field office for "additional processing". I'm really stressed out right now. I have no idea what that means or what they want. I scheduled an InfoPass appointment next Tuesday to find out.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

[how do you know it was for additional processing. my spouse who filed for me from dallas got a letter on oct 1st saying its been sent to another office. presuming it is dallas as that is our local office. but alot of people have had theirs transferred.

[how do you know it was for additional processing. my spouse who filed for me from dallas got a letter on oct 1st saying its been sent to another office. presuming it is dallas as that is our local office. but alot of people have had theirs transferred.

I called the USCIS and an ISO filed a service request with my local office (Houston). I called back because I had a question about the first ISO and the Houston office had already responded. The second ISO read me the letter. She said I will receive the actual letter in the mail in a few days.

Timeline

When I first learned of the case file transfer to the Dallas Office,

the ISO was telling me that I was pegged for a local interview.

go 5 weeks forward, and when I call in, the ISO has no record of the casefile being pegged for local interview.

Historically, if a casefile was sent to a local office prior to I-130 adjudication, it always meant the petitioner was to be interviewed.

Always.

Now that casefiles are sent to local offices direct from MSC, I think is a data error with USCIS,

as

those two data bits:

--casefile transferred to local office and

--interview with petitioner prior to I-130 adjudication

were tied together, almost 6 years (that I'm aware of)

so - I claim data error, unless you DO, indeed, receive a letter to show up at the local office.

Shifting it sideways, I also think the adjudication guidelines for standalone I-130s at the local office ARE NOT the same as CSC or VSC.

It's sorta free-range, with the each local office trying something different .

For clarity, get into the local USCIS office on an infopass - ask for the I-130 unit supervisor, don't leave till you've talked with that human. There's a layer of humans you must wade through, once there.

if you think yer local office is Dallas, then get into the local office on an infopass appointment,

and get to the I-130 unit supervisor, and ask yer questions.

That's the only human that's going to have answers.

Sure, the front desk clerk will try to be helpful, but he/she is useless.

If you punch in your zip code at the bottom of the page it should tell you your local office. It looks like Texas has a few offices.

My husband was going to be away for three months anyway because he was visiting on the VWP. The only thing that will change is whether he comes back home with or without a green card in hand. I can do this. We can do this. If we get a NOID then we'll just send in our stuff. It's going to be OK.
