My fiancee had her interview today in Manila. All went well, except one very small thing. On her birth certificate the mid-wife whom filled out the certificate spelled the family name wrong by one letter, she put an "E" in the name when it should have been an "A". And this was caught by the embassy workers. Fiancee was told to get a new NBI with the family name spelled with an "E" and send it to the Embassy. Consular did keep her passport to stamp with the Visa when they receive the needed documentation.

My questions are; Will the NBI office give her problems issuing her this new form with the other family name on it for the Embassy.

And if NBI does, how long will this process take to receive the visa.

Any input on this??

I think NBI will just rely on the identification card that your fiance will present to them. If her name is misspelled on her identification cards, I don't know if they will change it. Your fiance should go to a lawyer have get a notarized affidavit that her name was misspelled and bring it to NSO office to have her birth certificate corrected. This is just my opinion; wait for other responses. :)

I would also recommend getting the affidavit as described above...but my recommendation is on what I've read on similar situations, not my experience.

For what it's worth, it's good that they kept her passport. I think as soon as you get the NBI, assuming you can meet any requirements NBI has for this discrepancy, you will get the visa processed.

However, from personal experience, expect a month after the Embassy receives the NBI, and assuming they accept the NBI, until you get the passport with visa stamp. Once you "fall out" of the normal process, it takes some time to get any documentation reviewed. Don't make firm plans or plane tix yet...be patient.

With regard to NBI, it would be helpful to give them the document the embassy gave her at the exit interview (I assume it's the MNL-IV-22 form...). It would be INCREDIBLY helpful for you to go to the NBI with her and provide some firm encouragement if she's met with resistance or confusion. It was my experience with the NBI (getting fingerprints for foreign police clearance) that if you have to do anything out of the ordinary, the staff passes you on to the next person. Even better, if she knows someone in NBI, or knows someone who knows someone, it will be MUCH easier. If you are not able to be with her, and if she doesn't have a connection, tell her to be firm and persistent and to not leave NBI until she gets what she needs (or at least in process). So many people go through NBI facility each day, and the staff are overworked, so you must meet it with polite insistence.

To get the visa she needs to provide the embassy with NBI clearance in her current name, the name on her birth certificate, her maiden name, and any names shes ever used. She didnt do that, as her birth certificate has a different name on it (a misspelling)

All she has to do is return to the NBI and obtain a clearance record on her name as its printed on her birth certificate, so they can process her visa. (her other option would be to have her BC corrected, so that the clearance she has is valid, but I suspect to correct her BC would take a long time, so if you want this done quickly, obtain the clearance on the misspelled name- return to the embassy with the clearance and the visa will be issued. Be aware though, with out the corrected BC that means on your future AOS application, your wife will have to list her mispelled name as a prior name used, in addition to her correct spelling of her name as her maiden name, if she obtains a corrected BC then she would only have 1 prior name, her maiden name)

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

R.A. 9048 enacted in 2001 allows for clerical mistakes to be corrected on official documents to be made without a court order so you are lucky in that regard. You just need to pay a fee and present supporting documentation to have the correction made. It shouldn't take more than a few weeks to complete the process.

What they are wanting from NBI is the AKA name being the name on your BC is differently spelled. Simply take the letter the embassy gave you to NBI request the new NBI with the spelling as on the BC, NBI will send it over to the embassy. Once the embassy gets the new NBI and reviews the file once more and there are no more issues they will issue the visa.

You could be looking at a couple weeks or maybe a month once the new NBI is delivered, there is no solid answer on how long.
